M.V. ORDINANCE NO. 81-13 <br />Page -3- <br />state the reasons for refusing such approval. A report of <br />the Commission's action and a set of the preliminary development <br />plans shall be submitted to the Village Council which shall, <br />within thirty (30) days thereafte r, affirm, modify or reject <br />the action of the Planning Commission. Modification or rejection <br />of Planning Commission action shall require the affirmative vote <br />of not less than five (5) members elected to Council. Failure <br />to achieve such five (5) votes shall result in affirmance of <br />the Planning Commission action. <br />Section 1175.09 Authority to Proceed. After approval <br />of a preliminary plan by the Village Council, the developer shall <br />have two years from the date of such approval to proceed with <br />development and shall be guaranteed during such period that: <br />(A) The location and arrangement of buildings, walks, <br />parking and loading facilities and landscape areas will <br />be approved if contained in the final plans; and <br />(B) The general terms and any special conditions under <br />which the approval of the preliminary development plan <br />was granted shall not be changed by action of the <br />municipality. <br />Nothing in this Section shall be deemed to prevent the <br />developer from amending the preliminary plan prior to submittal <br />of a final development plan, but significant deviation from the <br />preliminary development plan shall be deemed to be sufficient <br />reason for rejection of a final development plan. <br />Section 1175.11 Final Development Plans. Following <br />approval of-the preliminary development plan, final development <br />plans shall be prepared for the proposed development at a scale <br />of one inch equals fifty feet, showing all of the information <br />required in a preliminary development plan but also including <br />detailed floor plans of buildings and detailed architectural <br />drawings. Architectural drawings and concepts shall be submitted <br />to the Architectural Review Board which shall approve the same <br />or recommend modifications within thirty (30) days after submission. <br />Eight copies of all drawings and plans shall be submitted with <br />the final development plan application along with a final <br />development plan application fee which may be set from time-to- <br />time, by Ordinance, by the Village Council, to be deposited to <br />the General Fund of the municipality for the purpose of defraying <br />the expense of reviewing final plan applications. <br />Upon submission of the final development plan to the <br />Planning Commission the Planning Commission shall commence review <br />of said plans at the next following meeting and shall, within <br />a reasonable time thereafter,. inform the developer of any other <br />information that may be needed before action by the Planning <br />Commission on the final development plan application. In no <br />event shall the Planning Commission delay action on the final <br />development plans, after receiving all requested information, <br />for more than sixty (60) days. <br />
