less than a full complement of firefighters for any reason whatsoever; <br />IT IS MUTUALLY AGREED by and between the parties hereto as <br />follows: <br />1. Each party hereto will respond, sofar as in the judgment <br />of the officer in charge of its Fire Department is consistent with the <br />proper protection of its own territory, on the emergency call of <br />the officer on duty and in charge of the Fire Department of the other <br />party hereto. <br />2. When an officer of any Fire Department calls for <br />assistance, he shall state the specific equipment and manpower needed, <br />shall give explicit directions as to the location where assistance <br />is needed and, whenever possible, shall dispatch someone to a <br />specific meeting place to escort the persons responding to their <br />destination. <br />3. It is further mutually agreed that all personnel of <br />the responding party, while responding to an emergency call of the <br />calling party, shall be acting within the scope of their employment <br />as firefighting personnel while enroute to, en~oute from and while <br />acting within the territory of the calling municipality. <br />4. It is further mutually agreed that no charge shall be <br />made for this service by either party. In no case shall the party <br />herein called upon or rendering such service be liable in damages <br />to the other party to this agreement, or its residents, or contractual <br />obligees, for failure to .answer any Fire Department call or for lack <br />of speed in answering such call or for any inadequacy of equipment, <br />negligent operation of equipment or for any cause whatsoever growing <br />out of the use of such fire fighting equipment and firefighters.
