ORDINANCE NO. 80- <br />Page -3- <br />The Mayor, or his authorized representative, shall issue a <br />permit for such alarm, provided that the intensity of sound <br />does not exceed eighty-five (85) decibels at any location <br />outside the premises being served. <br />971.06 FALSE ALARMS: <br />(a) No person shall fail to maintain equipment under <br />his control designed to give alarms of any type at less than <br />the level of maintenance necessary to prevent false alarms <br />from being emitted. <br />(b) It shall be prima facie evidence of unsatisfactory <br />maintenance in violation of Sec. 971.06 (a) if two (2} alarms <br />are emitted and reported in any manner to the Police or Fire <br />Departments for which no external cause can be found, provided <br />that such alarms occur within six (6) months of each other. <br />(c) The penalty for violation of Sec. 971.06(a) shall <br />be Ten Dollars ($10.00) for a first offense and Twenty-Five <br />Dollars ($25.00) for each subsequent offense. Prior to formal <br />prosecution, the person to be charged shall be notified of the <br />alleged violation and fine and shall be given not less than <br />ten (10) days nor more than twenty (20) days to voluntarily <br />waive his right to be charged and present a defense by signing <br />a waiver and paying the fine. Thereafter, prosecution may be <br />instituted. Failure to make satisfactory repairs after conviction <br />under this Section shall constitute a separate offense each <br />day such condition remains unabated. <br />(d) Notwithstanding the fine to be assessed, as set forth <br />hereinabove, no charge shall be made for a false alarm to which <br />there is no response by the Division of Police or the Division <br />of Fire nor when the cause has been proven to be an act of God. <br />971.07 EQUIPMENT REQUIREMENTS; OPERATION AND SERVICE: <br />(a ),,.All equipment used in installation for which a permit <br />is required shall meet the applicable standards of the <br />Underwriter s. Laboratories or the National Fire Protection <br />Association or other recognized industry standard, The applicant <br />may be required to submit evidence of the reliability and <br />suitability of the equipment to be installed. <br />(b) The sensory mechanism used in connection with such <br />devices must be adjusted to suppress false indications of <br />fire or intrusion so that the devices will not be actuated by <br />impulses due to transient pressure change in waterpipes, short <br />flashes of light, wind noises such as the rattling or vibrating <br />of doors or windows, vehicular noise adjacent to the installation <br />or other forces related to genuine alarms. <br />(c) All components comprising such device must be maintained <br />by the owner or lessee in good repair to assure reliability of <br />operation. <br />(d) Each alarm equipment supplier that sells or leases <br />to a person an automatic protection device which is installed on <br />
