ORDINANCE NO. 80-53 INTRODUCED BY: Council as a Whole AN EMERGENCY ORDINANCE LEVYING ASSESSMENTS FOR THE IMPROVEMENT OF ECHO ,DRIVE, LOCATED WITHIN HAYFIELD VILLAGE, OHIO, BY HAVING IT REPAVED AND REDITCHED. WHEREAS, this Council did, on the sixth day of August, 1979, duly adopt Resolution No. 79-52, declaring the necessity of the improvement therein and hereinafter described; and WHEREAS, this Council did, on the 15th day of October, 1979, duly adopt Ordinance No. 79-72, declaring the necessity of proceeding with said improvement and adopting the estimated assessments thereto- fore filed with respect to said improvements; and WHEREAS,.this Council did, on the 25th day of April, 1980 duly adopt Resolution No. 80-27 determining that said improvements should be made; and WHEREAS, the actual cost of said improvement has now been ascertained and has been placed on file in the office of the Clerk of this Council and has been reported to this Council; and WHEREAS, the estimated assessments for said improvement heretofore adopted by said Ordinance No. 79-52 have been adjusted so that said assessments, as adjusted, are in the same proportion to said estimated assessments as the actual cost of said improvement is to the estimated cost of said improvement; and WHEREAS, said adjusted assessments are now on file in the office of said Clerk of Council; now,. therefore, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: Section 1. The revised assessment of the cost and expense of improving Echo Drive in Mayfield Village, Ohio by having it repaved and reditched, amounting i.n the aggregate to $114,356..99 as reported to this Council on the 23rd day of July, 1980 by the Director of Finance of. the Village and now on file in the office of the Clerk of this Council, and the same is hereby adopted and confirmed and that there be and are hereby levied and assessed upon the lots and lands bounding and abutting upon said improvement the several amounts reported as aforesaid, which assessments, more fully enumerated in Exhibit,"A" attached hereto are in proportion to the special benefits and are not in excess of any statutory limitations.
