ORDINANCE NO. 80-53 <br />Page -2= <br />Section 2. This Council hereby finds and determines that <br />the revised assessments as now on file in the office of said Clerk <br />are in the same proportion to the estimated assessments as originally <br />filed as the actual cost of the above-described improvement is to <br />the estimated cost of the improvement as originally filed. <br />Section 3. The assessment against each lot or parcel of <br />land shall be payable in cash within thirty (30) days after the passage <br />of this Ordinance or, at the option of the owner, in twenty (20) semi <br />annual installments with interest at the same rate as shall be borne <br />by the bonds to be issued in anticipation of the collection of the <br />same. All cash payments shall be made to the Director of Finance <br />of the Village. All assessments and installments thereof remaining <br />unpaid at the expiration of thirty (30) days shall be certified by <br />the Clerk of this Council to the Cuyahoga County Auditor as provided <br />by law to be placed by him on the tax duplicate and collected as other <br />taxes are collected. <br />Section 4. The Clerk of this Council is hereby authorized, <br />empowered and directed to cause notice of the passage of this Ordinance <br />to be published once in a newspaper of general circulation in said <br />Village as required by law and to continue on file in her office said <br />revised assessments. <br />Section 5. The Clerk of this Council is hereby authorized, <br />empowered and directed to deliver a certified copy of this Ordinance <br />to the Cuyahoga County Auditor within twenty (20) days after its <br />passage. <br />Section 6. It is found and determined that all formal <br />actions of this Council concerning and relating to the adoption of <br />this Ordinance were adopted in an open meeting of this Council and <br />that all deliberations of this Council and any of its committees that <br />resulted in such formal action were in meetings open to the public, <br />in compliance with all legal requirements, including, but not limited to ,. <br />Section 121.22 of the Ohio Revised Code® <br />Section 7. This Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public peace, <br />health and safety of the residents of Mayfield Village in that it <br />will insure the prompt issuance of the bonds necessary to preserve <br />the credit of the Village by retiring the outstanding notes issued <br />in anticipation thereof. It shall therefore take effect immediately <br />upon passage by the affirmative vote of not less than :five (5) members <br />elected to Council and approval by the Mayor, or otherwise at the <br />earliest time allowed by law. <br />~~~~J/~~ <br />./ !/ 7 <br />President of Council <br />
