ORDINANCE NO. $0-69 INTRODUCED BY: Mr. Carmen AN ORDINANCE AWARDING 'A CABLE TELEVISION FRANCHISE TO VIACOM CABLEVISION OF CLEVELAND, A SUBSIDIARY OF VIACOM INTERNATIONAL, INC. i WHEREAS, the Council of 'the Village of Mayfield has found and determined that the public necessity and convenience of the Village of Mayfield would be served by a cable communication system; and WHEREAS, all valid and applicable regulations of the Federal Government and its appropriate agencies pertaining to granting of franchise and regulation of cable television of Mayfield Village have been followed; Now, Therefore, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. DEFINITIONS APPLICATION: means the written request of Grantee seeking a franchise and includes alllwritten proposals, in whatever form, made by Grantee to Mayfield Village concerning construction, rendition of services, maintenance or any other matter pertaining to the Cable Communication System or Cable Television Service. CABLE TELEVISION SERVICE shall mean that level of service proposed by Grantee in its application, which shall be the minimum service required of Grantee ,I and which shall, in any event, include, as to all subscribers in Mayifield Village: 1)°All signals of over-the-air television broadcasters required by the FCC to~be carried by a community antenna television system as defined by the FCC.; 2) such distant channels, not fewer than two, or over-the-air television broadcasters as Grantee may choose to carry, such distant channel carriage to be provided to subscribers not less than eighteen (18) hours per day; 3) such organization and access programming as may be required under Section 10 of this Ordinance; 4) such additional service as is required by Section 10 of this Ordinance. "Cable Television Service" shall include optional services for which Grantee makes a separate charge to subscribers whether on a monthly contract or a pay-per-use basis.
