ORDINANCE NO. 80-69 Page -2- CABLE COMMUNTCATION SYSTEM; SYSTEM: any organized array of antenna, satellite receiving dishes, electronic equipment and cables used by the Grantee to receive, amplify and retransmit signals incidental or necessary to provision of Cable Television Service, regardless of the location of such equipment or facilities. EMERGENCY: an existing condition or circumstance, or collection or sequence of conditions or circumstances sufficient to cause a normally prudent and reasonable individual to believe that a substantial threat of imminent bodily harm exists. FRANCHISE: shall mean the permissa;on;,. license or authorization given hereunder to construct, operate and maintain a cable television system in the Village. GRANTEE: The party or parties to which a franchise under this Ordinance is granted by the Council and its or their lawful successors and assigns. GROSS REVENUE: means any and all compensation, in whatever form exchange or otherwise, derived from all cable services within the confines o:~ the Village of Mayfield including, but not limited to, revenues from subscriber rates, pay cable, advertising, leased access channels, and installations, connection and reinstatement charges; provided, however, it does not include any taxes or services furnished by the Grantee imposed directly on any subscriber or user by a local, state or federally governmental unit and collected by the Grantee for such entity. LOCAL EDUCATION AUTHORITTES: shall mean those individuals, groups, organizations or governmental entities accredited by the State of Ohio which provide primary or secondary education, public or parochial, within the Village. SUBSCRIBER: A recipient of cable television service. VILLAGE: "Village" shall mean Mayfield Village, Ohio, a municipal corporation in and of the State of Ohio, in its present incorporated form or in any later reorganized, consolidated, enlarged or reincorporated form, and its duly authorized officials acting on its behalf. VILLAGE COUNCIL: COUNCIL: "Village Council" or "Council" shall mean the present governing body of the Village or any successor to the legislative powers of the present Village Council.
