M.V. ORDINANCE NO. 80-69 <br />Page -16- <br />informed decision by Council and may set a time limit <br />for such submission. Failure of Grantee to comply shall <br />be grounds for denying further consideration of extension <br />or renewal of the franchise. <br />Within forty-five (45) days following the public <br />hearing, Council shall do one of the following: <br />(a) extend the existing franchise for a further <br />period of ten (10) years from the expiration date of <br />the current franchise; <br />(b) grant a new franchise to the Grantee, on such <br />terms and conditions as Council may decide and Grantee <br />may accept, for a period not to exceed twenty-five (25) <br />years from the expiration date of the current franchise; <br />(c) invite Requests for Proposals (RFP's) from <br />Grantee and other companies. <br />Nothing in this Section shall be deemed to imply <br />any property right of. Grantee in expectation of renewal <br />of the franchise and the Village specifically reserves the <br />right to allow the franchise to expire. <br />In no event shall an extension of the franchise be <br />effective without written acceptance by Grantee. <br />SECTION 21. CONTINUITY OF SERVICE MANDATORY <br />It shall be the right of all subscribers to receive all available <br />services insofar as their financial and other obligations to the Grantee <br />are honored. In the event that the Grantee elects to overbuild, <br />rebuild, modify or sell the system, or the Council terminates or fails <br />to renew this franchise, the Grantee shall do everything in its <br />power to ensure that all subscribers receive continuous, uninterrupted <br />service regardless of the circumstances. In the event of a change <br />of Grantee, the current Grantee shall cooperate with the Village to <br />operate the system for a temporary period in maintaining continuity <br />of service to all subscribers. <br />SECTION 21A. SALE OR REMOVAL OF FACILITIES <br />In the event of termination of the franchise due to revocation or <br />expiration, Grantee shall within one hundred and eighty (180) days <br />after receipt of notice to do so by the Grantee from the Village, remove <br />all of its equipment, facilities and personal property from the Village, <br />wherever located or installed, including, but not limited to, trunk <br />distribution cable, feeder cable, drop cable, amplifiers, return <br />amplifiers, anchors, towers, antennae, satellite-receiving earth <br />stations and head-end equipment. Grantee's failure to do so within <br />the time limit specified in the notice shall afford the Village the <br />following options: <br />
