ORDINANCE NO. 80®69_ <br />Page -17- <br />a); to declare the remaining property abandoned and seize <br />it, without compensation to any person; <br />b) to remove the property, the cost of such removal being <br />a lien against the property and any other property of Grantee, <br />real or personal, located within the Village, such lien being <br />superior to all other claims arising after the effective date <br />of this franchise. <br />In the event of termination of the franchise due to revocation or <br />expiration, VAllage shall have the right to require Grantee to leave <br />all of its facilities in place, subject to Village's control, for a <br />maximum period of two (2) years. The Village, or any subsequent <br />Grantee of a franchise from the Village, during such two-year period, <br />shall have the right to purchase from Grantee, its heirs, successors, <br />or assigns at a price determined by appraisal by an appraiser mutually <br />satisfactory to Village and Grantee having experience in the appraisal <br />of broadcast or cable facilities, value to be determined at fair <br />market value of Grantee,;''s assets. In the event of inability of Village <br />and Grantee to agree on an appraiser, then each party shall appoint <br />an appraiser and in the event the two appraisers do not concur, they <br />shall appoint .a third appraiser whose award, not lower nor higher <br />than the range of the first two, shall be final. <br />SECTION 22. RIGHTS OF INDIVIDUALS <br />(a) Grantee shall not deny service, deny access, nor <br />otherwise discriminate against subscribers, channel users, or ge.ner«1 <br />citizens on the basis or race, color, religion, national origin or <br />sex.. Grantee shall comply at all times with all other applicable <br />federal, state and local laws and all executive and administrative <br />orders relating to non-discrimination. <br />(b) Grantee shall not refuse to hire_to emplog nor bar <br />or discharge from employment;. nor discriminate against any person in <br />compensation or in terms, conditions or privileges of employment <br />because o_f age, race, color, national origin or sex. Grantee shall <br />strictly adhere to the Equal Employment Opportunity requirements of <br />the FCC as expressed in the cable television Rules, 47 C.F.R. 76.311, <br />and as amended from time to time. <br />(c) Neither the Grantee nor the Village shall tap or monitor <br />or arrange for the tapping or monitoring, or permit, either expressly <br />or mpliedly, any other person to tap or monitor any cable, line, <br />signal input device, or subscriber outlet or receiver for any purpose <br />whatsoever, without the express written permission of the subscriber; <br />provided, however, that the Grantee shall be entitled to conduct <br />system-wide or individually-addressed "sweeps" for the purpose of <br />verifying system integrity, controlling return-path transmission, or <br />billing for pay service. <br />
