ORDINANCE NO. 80-6g- <br />Page.-18- <br />(d) The Grantee, or any~of its agents or`employees, shall <br />not, without..ahe specific written autYtrrization of, the subscriber <br />involved, sell, or otherwise make available to any party: ~(.l) lists of <br />the names and addresses of such subscribers, or (2) any list which <br />identifies the viewing habits of subscribers, except as the same <br />is necessary for the con,str:uction marketing and maintenance of the <br />Grantee's facilities and services.hereunder and the concomitant <br />billing of subscribers for said services. The Grantee shall not <br />provide information concerning the viewing habits of identifiable <br />individual subscribers to any party for any purpose whatsoever. <br />(e) Except as otherwise required by the FCC Rules for <br />Cable Television and Section 10 of this Ordinance, Grantee shall exercise <br />no control over the program content on any of the access channels. <br />Cf) Liability for obscenity, defamation or invasion <br />of privacy on any access channels shall rest with the person, group <br />.of persons, or any organization or coYporation utilizing said access <br />channels. <br />(g) Any party convicted of a violation under Subsections <br />-- (c) or (d) of this Section shall be subjected to a fine or not less <br />than Two Hundred Fifty Dollars ($250.00) and/or imprisonment of not <br />less than thirty (30) days for each violation. <br />SECTION 23. GRANTEE'S APPLICATION INCORPORATED <br />By its acceptance of the franchise, Grantee specifically <br />grants and agrees that its application is thereby incorporated by <br />reference and made a part of this Ordinance. In the event of a <br />conflict between ,proposed services listed in said application <br />and the provisions of this Ordinance, that provision which provides <br />the greatest benefit to the subscribers, in the opinion of the Village <br />Council, shall prevail,. Failure to provide services as promised in <br />Grantee's ap.pl~Gation as incorporated herein shall be deemed a breach <br />"of this Ordinance to which the provisions of Section 27 of this Ordinance <br />shall apply. <br />SECTION 24. SEVERABILITY <br />if any section, sentence, clause or phrase of the Ordinance is <br />held by a Court of competent jurisdiction to be unconstitutional or <br />otherwise invalid, such inf~~rmity shall not .affect the validity of <br />the Ordinance, and any portions in conflict are hereby repealed. <br />SECTION 25. SENIOR CITIZENS <br />An individual eligible for a State of Ohio "Golden Buckeye" card <br />may be eligible to receive a "senior citizen" discount as herein <br />provided. The person, to be eligible, must first present a "Golden.__ <br />
