ORDINANCE NO. 80=69_.- <br />Page -19-- <br />Buckeye" card or other identification, satisfactory to the Village,. <br />The Village-must then erify to the Company, in writing, that the <br />individual is eligible to receive the discount. The discount shall be <br />in the .amount of ten percent (100) and shall apply prospectively to the <br />cost of installation and basic Cable TV services:' The discount shall <br />apply only to services taken in the name of the eligible person and <br />said discount shall not be transferrable. The Village will cooperate <br />with the Company in~the application and enforcement of this provision. <br />SECTION 26. <br />Reserved for Future Use. <br />SECTION 27. ADDITIONAL FEES TO VILLAGE; CIVIL PENALTIES <br />It being agr-eed b'e'tween Grantee and Village that breach of <br />these provisions without prompt cure will result in loss and additional <br />adininistrative~cost to Village and that a fair and equitable measure <br />of such loss and cost, otherwise difficult of determination, is <br />Two Hundred Dollars (:$200.00) per day, Grantee shall pay to Village the <br />sum of Two Hundred_Dollars (-$200.00) per day as an additional charge <br />in the nature of~liquidated damages, although sometimes referred to <br />as "civil penalty", for°items specified in Section 12(c) and 23 of <br />this Ordinance. . <br />SECTION-28.` RATE REGULATION <br />A. The company shall have the autYior.ity to charge and collect <br />the schedule of installation charges and. rates contained in this <br />Ordinance unless and until the same shall be .increased. After the <br />expiration of the original rate guarantee period, the company may, <br />at any time, on 90-days prior written notice to the City, institute <br />a rate increase not to exceed any.,percent increase in the Consumer <br />Price Index (CPI') when said Tnde~~ has reflected a percent increase <br />over either: <br />1. The end-of -year Index figure of the base year of <br />1979; or <br />2: The CPI figure. as of the date of the last rate <br />increase. <br />B. The ncrease,shall occur no more than once in any calendar <br />year. <br />C. No increase shall take effect if, within 60 days after <br />notification, the City notifies the company that a hearing shall be <br />held on the proposed rate increase. The hearing shall be held within <br />60 days following the date of setting the hearing; otherwise, said <br />increase shall take effect. The only grounds for disapproval of a rate <br />increase otherwise permitted by this paragraph shall be a finding <br />that the company is. not .acting in accordance with the rates to which <br />it would be entitled based on CPI figures. <br />
