M.V. ORDINANCE NO. 80-69 <br />Page -5- <br />(f) The Grantee shall, upon request of any person <br />holding a building moving permit issued by the Village, temporarily <br />remove, raise or lower its wires to permit the moving of buildings. <br />The expense of such temporary removal or raising or lowering of <br />the wires shall be paid by the person requesting the same, and <br />the Grantee shall have the authority to require such payment <br />in advance. The Grantee shall be given not less than seventy-two <br />(72) hours advance notice to arrange for such temporary wire <br />changes. <br />(g) In all sections of the Village where the cables, <br />wires, or other like facilities of public utilities are placed <br />underground, the Grantee shall place its cables, wires or other <br />like facilities underground. <br />SECTION 7. SUPERVISION BY THE VILLAGE <br />(a) The Grantee shall construct, operate and maintain the <br />cable communications system subject to the lawful right of the <br />Village and its officials, employees or agents who have juris- <br />diction in such matters to enforce strict compliance with all <br />laws, ordinances, and departmental rules and regulations affecting <br />the system, but Grantee's obligation to comply shall be absolute <br />and shall not be released, waived nor compromised, as to third <br />parties, by the failure or error of the Village, its officials, <br />employees, or agents. <br />(b) The Cable Communications System and all parts thereof <br />shall be subject to the right of periodic inspection by the <br />Village. <br />SECTION 8. REMOVAL OF FACILITIES UPON REQUEST <br />Upon termination of service to any subscriber, the <br />Grantee shall promptly remove all of its facilities and equipment <br />from the premises of such subscriber upon his written request. <br />SECTION 9. CONSTRUCTION PLAN: PROGRESS REPORTS <br />(a) The Grantee shall submit with its acceptance of the <br />franchise a plan for the entire Village indicating the date on <br />which the Grantee expects the installation of the cable <br />television system to be completed and available for service to <br />subscribers in the various areas of the Village. <br />(b) The Grantee shall furnish the Village Council with <br />progress reports indicating in detail Grantee's compliance or <br />non-compliance with Section 11 as to construction of the system. <br />Such periodic reports shall be made at three (3) month intervals, <br />the first report to be made three (3) months from the date of <br />acceptance of the franchise. <br />
