M.V. ORDINANCE NO. 80-69 Page -6- SECTION 10. SERVICES AND FACILITIES; TECHNICAL STANDARDS (a) Services and Facilities: (1) The cable television system contemplated herein shall have a minimum channel capacity of thirty-five (35) channels each having a band width of six (6) megahertz in an overall spectrum of three hundred (300) megahertz available for immediate or potential use for the totality of cable television service to be offered. (2) Such system shall maintain a plant having current operational capability for non-voice return, or "two-way" communications. (3) The Grantee shall maintain the following: (A) At least one (1) specially-designated, non-commercial public access channel available on a first-come, non- discriminatory basis for programming. Except as otherwise required by the FCC rules for cable television, grantee shall exercise no control over program content on~any of the access channels. Liability for obscenity, defamation, or invasion of provacy on any access channels shall rest with the person, group of persons or any organization or corporation utilitizing said access channels. (B) At least one (1) specially-designated channel for use by local educational authorities; (C) At least one (1) specially-designated channel for leased access uses; and (D) At least one (1) specially-designated channel for local governmental uses; provided, if there is not an initial demand for activation of all four (4) access channels, Grantee may combine access programming on one (1) such channel until such time as the Council determines that additional channels are necessary. Said determination shall obligate Grantee to activate one or more of the separate channels herein listed. (4) The Grantee shall have available the following minimum equipment for production and presentation of public access programming. (A) a studio within the territorial limits of the Mayfield School District, preferably within a school building under the jurisdiction of such district; (B) two (2) color cameras with effect switcher;
