SERVICES AND FACILITIES; TECHNICAL STANDARDS <br />(a) Services and Facilities: <br />(1) The cable television system contemplated herein shall <br />have a minimum channel capacity of thirty-five (35) channels <br />each having a band width of six (6) megahertz in an overall <br />spectrum of three hundred (300) megahertz available for immediate <br />or potential use for the totality of cable television service <br />to be offered. <br />(2) Such system shall maintain a plant having current <br />operational capability for non-voice return, or "two-way" <br />communications. <br />(3) The Grantee shall maintain the following: <br />(A) At least one (1) specially-designated, non-commercial <br />public access channel available on a first-come, non- <br />discriminatory basis for programming. Except as otherwise <br />required by the FCC rules for cable television, grantee <br />shall exercise no control over program content on~any of <br />the access channels. Liability for obscenity, defamation, <br />or invasion of provacy on any access channels shall rest <br />with the person, group of persons or any organization or <br />corporation utilitizing said access channels. <br />(B) At least one (1) specially-designated channel <br />for use by local educational authorities; <br />(C) At least one (1) specially-designated channel <br />for leased access uses; and <br />(D) At least one (1) specially-designated channel <br />for local governmental uses; <br />provided, if there is not an initial demand for activation of <br />all four (4) access channels, Grantee may combine access programming <br />on one (1) such channel until such time as the Council determines <br />that additional channels are necessary. Said determination shall <br />obligate Grantee to activate one or more of the separate channels <br />herein listed. <br />(4) The Grantee shall have available the following <br />minimum equipment for production and presentation of public <br />access programming. <br />(A) a studio within the territorial limits of the <br />Mayfield School District, preferably within a school <br />building under the jurisdiction of such district; <br />(B) two (2) color cameras with effect switcher; <br />
