ORDINANCE No. 106-1952 By' Mrs. Cass AN EMERGENCY ORD IlVANCE DETERb4INING TO PROCEED VdITH THE Ii~!'ROVEMENT OF S.O.M. CENTER ROAD FRAM THE CENTER LINE OF WILSON MILLS ROAD TO THE SOUTH CORPORATION LINE OF MAYF?ELD VILLAGE BY THE CONSTRUCTIOhT OF A WATER MAIN AND APPURTENANCES THEREIN. WHEREAS this Council adopted Resolution No. 199-1952 on January 21, 1952, declaring the necessity of improving S.O.M. Center Road from Wilson Mi17.s Road center line to the south corporation line of Mayfield Village by the construction of'a water main and appurtenances in accordance with the plans, specifications, estimates, profiles prepared by the Village Engineer and nova on file zm the office of the Clerk of Mayfield Village, and WHEREAS a certificate of the Clerk has been filed with Council showixag service of notice of the passage of such resolution No. 199-1952 on the owner of each piece of property abutting on said S.O.M. Center Road from the center line of Wilson Mills Road to the south corporation line of Mayfield Village9 and WHEREAS the Clerl~ has certified that no claims fo-r damages have been filed during the claim period, and WHEREAS the Council of Mayfield Village desires to proceed with the said improvement: BE Ii' ORDAINID BY THE COUNCIL OF THE VILLAGE OF ~fAYFIELD, STATE OF OHIO, THREE-~URTHS OF ALL R'~ERS ELECTED THERETO CONCURRIlVG: Sec. 1, That it is hereby determined to proceed with the improvement o~S.O.P.~. Center .Road from Wilson BiLills Road to the south corporation line of Mayfield Village by establishing the grade and con- structing a water main, all in accordance with resolution No. 199-1952, adopted January 21, 1952, and in accordance with the plans, specifications, estimates and profiles heretofore approved and nowt .on file in the office of the Clerk of said Village. Sec. 2. That all claims for damages resulting therefrom shall be judicially inquired into after the completion of the proposed improvement and the Solicitor be, and he is, hereby authorized to institute proceedings in a court of competent jurisdiction to inquire into claims. Sec. 3. That eighty six and 65/100 percent (86.65) of the cost of said improvement shall be assessed in proportion to the benefits vrhich may result from the improvement upon the following described lots and lands, to-~eu:it: alI the lots and lands bounding and abutting upon the~easterlty and westerly side of S.O.M. Center Road from the center line of Wilson Mills Road southerly to the south line of the corporation line of Payfield Village, in the Village of Mayfield, Ohio, which said lots and lands are hereby determined
