PRIVATE CONTRACTORS TO CON1dECT <br />jl~tATER LPiTES trTITH VILLAGE ti7AT~R 11~,AINS <br />BE IT ORDAINED BY THE COUNCIL OF THE VILILL~,GE OF M.AYF~LD, CUYAHOGA COUNTY <br />oHla, TF-LA T v <br />Sec. 1. Any private contractor shall be permitted to cross village <br />roads and highways, to connect with Village of ~.!tayfield plater Niains upon <br />the following terms and conditions <br />(a) He shall obtain a permit for such work in such form as <br />shall be prescribed by the Village Solicitor and signed by the <br />Village Street Commissioner. Anyone obtain ng such permit shall <br />agree to repair promptly all broken pavement and to back fill with <br />sand or gravel any hole or excavation caused by the vrork done, to <br />the satisfaction of the Street Commissioner, to absolve the Village <br />of ~~ayfield and City of Cleveland from all liability for the work <br />therein authorized and to indemnify the Village of Mayfield and <br />City of Cleveland against aa~y liability for injury to the street <br />or to person or property by reason of such work; <br />(b) He shall carry liability insurance, protecting the <br />Village of Iaiayfield and City of Cleveland in the amount of <br />X100,000.00 as to any one person a.nd X300,000.00 as to all persons <br />by reason of injury to person or property caused by the work so <br />authorized.' The Village Street Commissioner may require the <br />contractor •todeposit said policy or proof thereof ~~ri_th him; <br />(c) A cash bond of y,~150.00 shall be posted for each connec- <br />tion as security for performance of the terms of the permit, which <br />amount shall be refunded when the job has been completed, the <br />pavement repaired and any exca,va,tions back-filled to the satisfaaction <br />of the Street Commissioner; and upon failure of the contractor to <br />do said things, the Village may apply the amount of the deposit <br />toward payment for having the work dune and sha71 return to the <br />permit holder the unexpended balance, if any. If the cost of <br />r~pairing• the pavement and making the back-fill shall exceed the <br />amount of the cash deposit, the permit holder shall be liable to <br />the Village for the excess; <br />(d) In lieu of posting cash bonds, as provided in paragraph; <br />(c) of this section, a. contractor ma.y furnish the Village with a <br />bond in the amount of X1,000.00, executed by an acceptable surety <br />compai~y, in form to be. approved by the Village Solicitor. Said <br />bond shall cover all vrater connections made by the contractor in <br />the Village during t~.e calendar year in which it is posted. <br />
