MAIN. .~ -. . _ _ .' <br />~'YHEREAS, there has been regularly presented to the Council of <br />the Village_ of Mayfield' Cuyahoga County, •~State' of Ohio, a Petition in <br />writing, subscribed by three-fourths in interest of the owners and the <br />owners of more -than 60p of the .foot frontage of the property abutting upon <br />Seneca Road from SOM Center Road in an. Easterly direction to the Westerly <br />line of Beech Hill Road, praying that the entire cost of construction of <br />an 8~~ water main and appurtenances in said Seneca Road between said points, <br />including the cost of improving street intersections and such pa rt of <br />the cost of said improvement as is ordinarily paid or required to be <br />paid by the Villages under the provisions of Section 727.16 of the <br />Revised Code of Ohio, or under any other statutes authorizing or requiring <br />a municipal corporation to pay a part of such cost, shall be assessed in <br />proportion to the benefits that might result from such improvement to the <br />lots and lands fronting on said street between said points, without <br />reference to the value of the lands of those Vvho subscribed to said Petition, <br />and <br />tirVIiEREAS, this Council adopted Resolution No. 228 on August 17, 195, <br />declaring the necessity of improving Seneca Road in the Village of IuI~yfield, <br />Ohio, from SOM Center Road in an~Easterly direction to the Westerly line of <br />Beech Hi17. Road by the construction of a water main and appurtenances, in <br />accordance with the plans, specifications, estimates and profiles prepared <br />by the Vi.].lage Engineer and now on file in the office of the Clerk of the <br />Vi11a ge of Mayfield, and <br />T~REAS, a Certificate of the Clerk has been filed with the Council <br />showing service of notice of the passage_of such Resolution No. 228 on the <br />owner of each piece of property abutting on Seneca Road from_SOM Center Road <br />in an Easterly direction to the Irdesterly line of Beech Hill Road, an d <br />ti'JHEREAS, the Clerk has certified that no claims for damages have <br />been filed during. the claim period, and <br />VVI~REAS, the Council of the Village of Mayfield desires to proceed <br />with said improvement. <br />BE IT ORDA IlUED BY THE COUNCIL OF THE VILLAGE OP NIAYFIELD, COUNTY <br />OF CUYAHOC~, STATE ,OF OHIO: _ . - _ _ <br />Seco to That it is hereby determined to proceed with the improvement <br />of Seneca Road in the Village of ~:layfield, Ohio, from SOPI!
