-2- <br />the grade and constructing a water main, all in accordance with Resolution <br />Tdo. 228, adopted August 17, 1953, in accordance with the Petition of <br />property owners described iia said resolutioon and hereinabove described' <br />and in accordance with the plans, specifications' estimates and profiles <br />heretofore approved and now on file in the office of the Clerk of said <br />Village. <br />Sec. 2. That all claims for damages resulting therefrom shall be <br />judicially a gn~ia.red into after the completion of the proposed improvement <br />and the Solicitor be, and he is, hereby authorized to institute proceedings <br />in a court of competent jurisdiction to enquire into claims. <br />Sec. 3• That the entire cost of said improvement shall be assessed <br />in proportion the benefits which may result from the improvement upon <br />the following described lots and lands, to writ: All the lots and lands <br />bounding and abutting upon both sides of Seneca Road in the Village of <br />Mayfield, Ohio, from SOM Center Road in an Easterly direction to the Vi~esterly <br />line of Beech hill Road, which said lots and lands are hereby determined to <br />be specially benefitted by said improvement; provided, however, that the <br />parcel of property on the Northeast corner of Seneca Road and SOM Center <br />Road ovmed by C. C. and T.. tiV. Scheuring, being Auditor°s Permanent Parcel <br />No. 831-3g-1 shall be exempted its full 157 feet from the assessment for <br />the cost of improving Seneca Road, and that the property on the Southeast <br />corner of Seneca Road and 50114 Center Road owned by Robert S. Copelin, <br />being Auditorts Permanent Parcel No. 831-38-20 shall be exempted its <br />full 1~.7 feet_frontage from the assessment for the cost of improving <br />Seneca Road, for the reason that both of said exempted parcels are being <br />assessed for a similar water main improvement constructed on SOM Center <br />Road; that the cost of said improvement shall include the expense of the <br />preliminary and other surveys, and of printing ahd publishing the notices9 <br />resolutions and ordinances required, and the serving of said notices, and <br />the cost of construction, together with interest on notes and bonds issued <br />in anticipation of the collection of deferred assessments, and all other <br />necessary expenditures. <br />Sec. ~. That the assessments so to b e levied shall be paid in <br />ten (10) annuminstallments, with interest on deferred payments, at the <br />same.,rate as shall be borne by the bonds to be issued in anticipation of <br />the collections thereof; provided, that the or~er of any property assessed <br />may, a t his option, pay such assessment in cash within thirty (30) days <br />from and after the passage and legal publication of the assessing ordinances. <br />Sec. 5• The bonds of the Village of ~Tayfield shall be issued in <br />anticipation of the, collection of assessments by installments and in an <br />amount equal~~hereto, and notes of sa3.d Village of Mayfield shall be issued <br />in anticipation of the levy of such assessments and .the issuance of bonds. <br />Sec. 6. That the Clerk and itlayo-r of the Village of Mayfield be, <br />and they hereby are, authorized and directed, as soon as funds therefore are <br />available, to make and execute a contract for said improvement vuith the <br />lovrest and best bidder, after advertisement according to law. <br />
