Section P-2. Interpretation; purpose. In interpreting and applying <br />the provisions of this ordinance, they shall be held to be the minimvsn require- <br />ments adopted for the promotion of the pub]Lie health, safety, comfort., convenience <br />and generaZ weZfare. The Zot or yard areas required by this ordinance f'or a <br />particular building shall not be diminished and sha7l not be included as a part <br />of the required lot or yarr1 areas of ar?y other building. The I.ot or yarr1 areas <br />of buildings existing a.t the time of the passage of this ordinance shall not be <br />diminished beZow the requirements herein provided for bui7dings hsreaf ter er8cted <br />a.nd such requix°ed areas shall not be ineZuded as a part of the required areas of <br />any building hereafter srected. This ordinance shall nQt repeal' abrogate,, annul <br />or in any Way impair or interfere with any ex.isting provisions of Iaw or ordinance <br />or any ruZes or regul.ations grevioU:sly ar3.o?,?ted or issued or znihich shall be adopted <br />or issued pursuant to la-w relating to the use of buildings or premises; nor shaLl <br />-this ordinance interfere vrith or abrogate or annul any easements, covenants or.other <br />-agresments betvaeen parties; prov3.ded, ho-wever, that where this ord.inance imposes a <br />greater restriction upon the use Qf buildings or gremi.ses or upon the height of <br />build.ings or requires Iasger yards than are imposerl or requirecl by such existing <br />provisions of Iaw or ordinance or by such ru1es, reguZations or by such easem.ents., <br />covenants or agreement, the provisions of this oiclinance shall controlo <br />Section 23. Amendments. The council may from time to time on its otian <br />motion or on petition' after pub7_i.c notice and hearing., amend the reg,?Iations anc3 <br />districts herein estabZishe?. Evezy such proposed amendment sha31 be referred by <br />the counciZ t:ix the city planning and zoning commission for report. Any such <br />amendment that has failed to receive the approval oi-the city pl.anning and zoning <br />commission sha.IZ not be passed by -the counciZ except by a three-fourths vote. 2f <br />a protest against such amendment be presented d.uly signed and .acknowl-edged by the <br />o-wn.ers of 20 per esnt of ths Tand -within such a-rea groposed to be a1tered, such <br />a.mendment s}ZaLL n.ot be ga.ssed except by a three-faurths vote of the council. If <br />. such amendmen.t wiTl transfer an area to a Iess restricted use' height ar area <br />district and.a protest is presented r).uTy signed arid acknoTiIedged by the oinmers of <br />2E3 per cent of the la.nd adjacen,t to and wit'_ni.n P-QO feet from such area proposed to <br />be tr.ansf erred and within "a more restricted usq., height or. area district than the <br />district in ?rhich such area is proposed to be transferred., snch amendment shall not <br />be passed except by a three fourth.s vote oi th.e, council. Whenever the owners of <br />50 per cent of the lan.d in any area shalZ present a petition dU1y signea:and acknow- <br />Iedged to the cauncil requesting a.n amendment of the regulations prescribed for <br />such :area, i-t shall be -the cl.uty of the eouncil to vote upon such -.mendment within <br />90 da.ys of the fil.ing of same by the petitioners vTith the village clerk. If any <br />area is hereafter transferred to'another district by a ehange in the district bound- <br />a.ries by amendm.ent as provided in this section' the provisions of this ordinance <br />with regard to buiZdings or premises exi.sting at the time of the passage of this <br />ordinance shall apply to buildings or premises existing in such transferred area <br />at the time of the pa.ssage of such ameridinent. <br />Section 24o Comgletion annd restoration of existing buildings. Nothing <br />herein contaaned.shall require any change in th? pla.n.s, construction or designated <br />use of a building for which a buiTd.ing permit }aas been heretofore issued and the <br />construction of -which shall have been di1igently prosecuted within. 30 da.ys of the <br />, date of sueh permit' and the ground story framevroik of which, including the second <br />'tier of beams, shall have been completed within 6 months of the date of such permits, <br />and -which entire buiTding shaI1 be compTeted accorciing to such plans, as filed, <br />ivithin twa years f°rom the d.ate of the passage of this ordinance. Nothing in this <br />ordinanee shaI1 prevent the restarati:on.of a building whol.Ty or partly d.estroyed <br />by fire, explosion, a.ct of God or act of the public enem,y? subsequent to the <br />-11-
