Brown Seconded by Mr. Strater AN EMERGENCY ORDINAR~E DETERMINIRTG TO PROCEED WITH THE IMPROVEMENT OF GLETNTE?^~.ROAD IN THE VILLAGE OF HAYFIELD, OHIO, FROM,SOM CENTER ROAD IN.AN EASTERLY DIRECTION.TO. THE ~r7ESTERLY LINE ,OF BEECH HILL RQAD. BY.. THE .CONSTRUCTION OF A Zi~ATER_ MAIN AND .APPURTEIJANCES THEREIN.. _ TrJF~REAS, there has been regularly presented to the Council of the Village of Ma3~field, Cuyahoga County, State of Ohio, a Petition in writing, subscribed by three-fourths in interest of the owners and the owners of more than 60~ of the foot frontage of the property abutting upon Glenview Road from SOM Center Road in an Easterly Direction to the TrTesterl~T Lne of Beech Hill Road, praying that the entire cost of construction of a water main and appurtenances in said Glenview Road between said points, including the cost of improving street intersections and such part of the cost of said improvement as is ordinarily paid or required to be paid by the Village under the provisions of Section 727.13 of the Revised Code of Ohio, or under any other statutes authorizing or requiring a municipal corporation to pay a part of such cost, shall be assessed in proportion to the benefits that might result from such improvement to the lots and lands fronting on said street between said points, vrithout reference to the value of the lands of those who subscribed to said Petition; and ?n7HE ~ S, this.Council adopted Resolution No. 317 on December 19th, 1955, declaring. file necessity of improving Glenview Road in the ViLage of Nia.yfield, Ohio, from SOM Center Road in an Easterly direction'.,to the. lydesterly line of Beech Hill Road_by the construction of a water main and appurtenances, in accordance with the plans, specifications, estimates and profiles prepared by the Vil.l.age ;Engineer and nova on file in the office of the Clerk of the Village .of N~ayfield; and T,+VF~'REAS, a Certificate of the Clerk has been filed with the Council showing service of notice of the passage of such Resolution No. 317 on the owner of each piece of property abutting on Glenview Road from SCM Center Road in an Easterly direction to the Westerly line of Beech Hill Road; and ~~RF' S, the Clerk has certified that no claims for damages have been filed during the claim period; and WFIEREAS, the Council of the Village of Mayfield desires to proceed with said improvement. _ NO'wT THEREFONE BE IT ORDAINED BY THE COUPICIL OF THE VILL9.GE OF N~A.YFIELD, COUAITY OF CUYAHOGA, STATE_ OF OHIO: THAT:_ _ -. .
