Ido. 317, adopted December 19th, 1955, in accordance with the Petition of <br />property oUmers described in said resolution and hereinabove described, <br />and in accordance with the plans, specifications, estimates and profiles <br />heretofore approved and now on file in the office of the Clerk of said Vi].1.age. <br />Sec. 2. That a1.7. claims for damages resulting therefrom shall be <br />judicially enquired into after the completion of the proposed improvement <br />and the Solicitor be, and he is, hereby authorized to institute proceedings <br />in a court of competent jurisdiction to enquire into claims. <br />Sec. 3e That the entire cost of said improvement shall be assessed <br />in proportion to the benefits which may result from the improvement upon <br />the foLe*~i.ng described lots and lands, to-wit: All the lots and lands <br />botmding and abutting upon both sides of G1.envieUrRoad in the Village of <br />Mayfield; Ohio, from SON Center Road ir_ an Easterly direction, to the 7r~esterly <br />line of Beech Hill Road, which said lots and lands are hereby determined to <br />be specially benefitted by said improvement9 provided, however, that the <br />' parcel of property on the Nottheast corner of Glenview Road and SOM Center <br />Road owned by George F® & M. B. Ti~Teiland, being Auditors Permanent Parcel <br />No. 831-38-7.La., shall be exempted its full 207 feet from-the assessment for <br />the cost of improving GlenviewRoad, and that the property on the Southeast <br />corner of Glenview Road and SOM Center Road owned by T, & Ae Ce Thrush, being <br />Auditor's Permanent ,Parcel No. 831-38-13, sha]1 be exempted its fu7~. 207 <br />feet frontage from the assessment for the cost of improving Glenvietir Road, <br />for the reason that both of said exempted parcels have already been assessed <br />for a similar water main improvement constructed on SOM Center Road and <br />said parcels wi17. receive no benefit from the Glenview Road improvement; <br />' that the cost of said improvement sha71. include the expense of the <br />' prel.i.minary and other surveys, and of printing and publishing the notices, <br />resolutions and ordinances required, and the serving of said notices, and <br />', the cost of construction, together with interest on notes and bonds issued <br />in anticipation of the collection of deferred assessments,, and. all other <br />necessary expendituresm <br />Secs ?a.® That the assessments so to be levied shall be paid in ten <br />(10) annual ir~tallments, with interest on deferred payments, at the same <br />rate as shall b e borne by the bonds to be issued in anticipation of the <br />collectior_s thereof; provided, that the owner of any property assessed <br />may, at his option, pay such assessment in cash tirithin thirty (30) days from <br />and after the passage and legal publication of the assessing ordinances. <br />Sec ® 5. The bonds of the Village of 1ayfield shall be issued in <br />anticipation of the col~ction of .assessments by installments and in an <br />amount equal thereto, and notes of said Village of Mayfield shall be issued <br />in anticipation of the levy of such assessments and the issuance of bonds. <br />Sec. 6o That the Clerk and Mayor of the Village of Mayfield be, <br />and they ,hereby are, authorized and directed, as__soon as funds therefore are <br />available, to make and execute a contract for said improvement with the <br />lowest and best bidder, after advertisement according to labds <br />
