PUBLIC .UTILITIES IN THE <br />VILLAGE OF HAYFIELD AND REPEALING ORDINANCE . NO.. lall~ <br />BE IT ORDAINED BY THE COUNC ZG OF THE VILLAGE~OF HAYFIELD, CUYAHOGA COUNTY <br />OHIO, THAT: - -- ^ - - _ - - <br />Sec. 1. No person, firm or corporation shall make or. cause to be <br />made any opening or excavation in the paved or unpaved portion of any <br />vill~e read or highway, whether dedicated or undedicated, nor cross any <br />such vi7.l.age road or higin~ay to connect with any sewer, water main, or <br />other pub]a.c utility, except upon the following terms and conditions: <br />(a) He shall obtain apermit-for such work in such. form as shall be <br />prescribed by the Village Solicitor and signed by the Village <br />Street Commissioner. Ai~yone obtaining such permit shall agree <br />to repaix° promptly all broken pavement and sidewalks and to <br />back fill with sand or gravel arty hole or excavation caused <br />by the work done, to the satisfaction of the Street Commissioner, <br />to absolve the Village of Mayfield and City of Cleveland from <br />all liability for the work therein authorized and to indemnify <br />the Village of Mayfield and City of Cleveland against any <br />liability for injury to the street or to person or property <br />by reason of such work. A,.-fee of X5.00 payable to the Village <br />of Mayfield, shall be paid for each permit-granted hereunder, <br />(b) He shall carry liability insurance, protecting the Village of <br />Mayfield and City of Cleveland in the amount .of X100,000.00 as <br />to any one person and_~300;000.00 as to .all persons by reason <br />of injury to person or~ property caused by'~the work so authorized. <br />The Village Street Commissioner may require the contractor to <br />deposit said-_policy or proof thereof with him, <br />(c) A cash bond of X150.00 shall be posted for each connection, <br />opening and excavation as security for performance of the terms <br />of the permit, which amount shall be refunded when the job has <br />been completed, the pavement repaired and any excavations back- <br />filled to the satisfaction of the Street Commissioner; and upon <br />failure of the contractor to do said things, the Village may <br />apply the amount of the deposit toward payment for having the work <br />done and shall return to the-permit holder the unexpended balance, <br />>rf arr. If the cost of repairing the pavement and making the back- <br />fill sha11 exceed the amount of the cash deposit, the permit holder <br />shall be Li.abl~ to the Village for the excess; <br />
