(d) In lieu of posting cash bonds, as provided iri paragraph (c) of _ this section, a contractor may furnish the Vi7.lage with a bond in the amount of X1,000.00, executed by an acceptable surety company, in form to be apps owed by the Village Solicitor. Said bond shall. cover a12. water connections,_.sewer connections, _• openings and excavations made by the contractor in the Village during the calendar year in which it is posted. __ Sec. 2® Any person who makes an opening or excavation .in the paved or unpaged portion of any road or highway in the Village of Ma~~ield without first obtaining a permit, and any person who makes such an opening or excavation and fails-to comply w1.th the provisions. of any permit granted for such purpose, shall be guilty of a misdemeanor and upon conviction thereof shall be fined not more than X500.00, and each of such violation shall•constitute aseparate offense® • Sec. 3o The Village So7.:ieitor is hereby authorized to take action to enjoin-the violation of this ordinance and to; recover damages suffered by the Village because of any violation of this ordinance and to take action to enforce the conditions of the bond provided for in Section 1.
