3) Contract for the construction of a temporary pavement. <br />In order to provide for the maintenance of the temporary <br />pavement the Owner shall deposit in the name of the <br />Village in a bank or savings and loan company an amount <br />to be fixed by the Village Engineer, equal to 59 of the <br />total cost of the temporary pavement. If the Ocrner <br />refuses to comply with the Village Engineer's order to <br />perform any such maintenance as may, _be required, the <br />Vi.l.7.age E ~ .Weer shall proceed to do such work using <br />funds previously deposited for the maintenance of the <br />temporary pavementm <br />The Contractor shall provide evidence that he is carrying <br />public liability i.n.surance covering himself and the Village <br />in the amount of x$100,000 _ X300,000. __ <br />e. The Owner shall present to the Village Engineer an estimate <br />of cost for subgrading and constructing ;a permanent pavement <br />in accordance with the specifications attached to this <br />Ordinance. A surety Bond, or security in such form as may <br />be approved by Council, in the amount of 100 of this estimate <br />or as rev5.sed by the Village Engineer, shall...be given the <br />Village guaranteeing that all_this work wilt be completed <br />during the summer or fall following the completion of all <br />underground construction, which date of completion of the <br />permanent pavement shall not be later than Eecember 15th <br />of the year the work is started. " <br />Sec. 2. This Ordinance is hereby declared to be an emergency measure, <br />necessary for Fie immediate preservation of the peace, health, safety, and <br />welfare, because of the fact that it is necessai~r to estab]ish as s~onn as possible <br />regulations requixing concrete pavement and other r osculations for the improvement <br />of streets, i.ri order to prevent the establishment of streets taY~ich will require <br />unnecessary expense on the part of the Village for their upkeep and repair' <br />and this Ordinance shall take effect from and after the date of its passage. <br />Passed this ~ day of `~1,~ , 195'l. <br />Attest: <br />Clerk <br />•~ <br />Mayor e resident of. ouncil.. <br />
