Seca 3a That 8~:5o_oftl~e cost of said improvement shall be assessed <br />in proportion to the benes""its irhich may resul-~ from the improvement upon <br />the following described lots and lands, to-wit: All the lots and lands <br />bounding and abutting upon the East side of Lander Road in the Village of <br />I`Za.~rfield, Ohio, from l~ilson Mills Road in a Southerly direction tc the <br />South Corporation line of the Village of Mayfield, Ohio, which said lots <br />and lands are hereby determined to be specially benefitted by said improvement; <br />provided, hotiTever, that the parcel of property on the Southeast corner of <br />Lander Road and ~~ilson ~~ills P~oad owned by James Lin, and kno.,~n as Auditor' a <br />Permanent Noa 831-31®26, shall. be totally exempt from said assessment for - <br />the reason that said parcel of property has already been assessed for a <br />similar water main improvement constructed in ~~ilson Nii.lls Road and it <br />would be inequitable to assess said property for the Lander Road Improvement; <br />that the cos•c of said improvement shall include the expense of the preliminary <br />and other surveys, and of printing and publishing the notices, resolutions <br />and ordinances required, and the serving of said notices, and the cost of <br />construction, together with interest on notes and bonds issued in anticipation <br />of the collection of deferred assessments, and all other necessary expendi- <br />ture s <br />Sece ~Q That the assessments so to be levied shall be paid in ten <br />(10) annual installments, with interest ,on deferred payments, at the same <br />rate as shall b e borne by the bonds to be issued in anticipation of the <br />collections thereof; provided, that the owner of any property assessed <br />may, at his optior_, pay such assessment in cash within thirty (30) days (roan <br />and after the passage and legal publication of the assessing ordinances. <br />Sec® 5. The bonds of the Village of 1~'layf field shall be issued in <br />anticipation of the collection of. assessments by installments and an an <br />amount equal thereto, and notes of said Village of l~jayfield shall be issued <br />in anticipation of the levy of such assessments and the issuance of bonds® <br />' Sec ® 68 That the Clerk and T°1ayor of the Village of Mayfield be, and <br />they hereby are, authorized and directed, as soon. as funds therefore are <br />available, to make and execute a contract for said improvement tiTj:th the <br />lOLTeSt and best bidder, after advertisement according to law® <br />Sec® 7® That this Ordinance sha11 take effect as an emergency measure <br />for the reason that the funds are required far® the irarneds.ate construction <br />' of said improvement for the peace, health and safety of the inhabitants of <br />the Village of Iayfield, and shall take effect and be in fuL force from <br />and after the date of its passaged <br />Passed this 18th day of March, 1957+ <br />Attest: ~~ <br />~"~,~~ <br />liayor - resident of ouncil <br />SEAM lerk <br />
