COUNTY <br />OHIO, THAT: <br />Sec. 1. No person9 fi.rm, or corporatian shall make or cause to be <br />made any opening or excavation in the paved or unpaved portion of any <br />vi].lage road or highway9 whether dedicated or undedicated, nor :eross "- <br />any such village road or highway to connect with ar;y sewer, wa'-?er main, <br />or ather public utility' except upon the following terms ard condit3.ons s <br />(a) He shall obtain a permit for such work in such form as <br />shaJ1 be prescribed by the Village Solicitor and signed by the Village <br />Street Cormnissioner. Arayon:e obtaining such permit sha1l agree to repair <br />and sha].l repair promptly all b roken pavement and sidewal.ks' and shall. <br />agree -to and shall baakfill wi.th sand or gravel ariy hole or excavation <br />caused by the work done, to tHe satisfaction of the Village Street <br />Commissioner, and shall f'urther agree to absolve the V'illage of Mayfield <br />( and also the City of Cleveland in cases of water mains) from a7.l <br />1a.ability for the work authorized by such permi.t and to indemnity the <br />Village of illayfield ( and the City of C.l.eveland in cases of iaater maim) <br />against arr.y liabi].ity for injury to the street or to person or property <br />by reason of such -v1ork. A fee of 65.00 payab7.e to the Vi].].age of Mayfield, <br />sha]1 b e paid for each permi.t granted hereunder. Such permit ho7.der shall <br />barricade a11 excavations on and off the exi.sting street lire, and sha.11, <br />for the period beginning one hour before sundawh and ending one hour after <br />sunrise during the progress of such work, plainly mark and indicate the <br />presence of a11 barricades, fences, canopies, equipment' piles of material <br />and piles of debris exi.sting on or near the existing street line' using f].ares9 <br />red lanterns or red electric light_bulbs to warn persons and operators of <br />vehicles of the presence of the samem IIpon fai].ure of the permit ho3der <br />to erect the barricades and to set out the means of i7.1.umination herein , <br />required., the vil7 age street cornmissioner or any member of the village <br />police department may do so, and the perm3.t ho7Lder shall in sueh case pay <br />to the Vi17.age the sum of '420900 for each day on which the street . <br />Crnnmissioner or a member-of the police depar-iinen.t has erected sueh barricades <br />or set out such means of illurnination and shall also pay the reasonab].e cost <br />of ariy niateria7Ls used for such pux°pose by the Village af t4ayFieZda <br />(b) tHe sl1al'!. carry liability insurance proluecting the ViLage <br />or Mayfield ( and the Cit,y of Cleveland in cases of wa-ter mains) in the <br />amount of $100,000.00 as to an,y one person and $300*000.00 as to a11 persons <br />by reason of gersonal injury or death and in.the amount of $1$000o00 by <br />reason of damage to property caused by tlle vorlc authorizPd by said perrni.t. <br />The Village -Street Connni.ssioner may require the pe?. t ho3J. er to deposit <br />said po7.icy or proof -lhereoi tTith'him,
