BE IT ORDA7IM BY THE COUNCIL OF ^1HE VII,LAGE OF MAYFIELD, CUYAHOCsA. COUNTY OHIO, THAT: Sec. 1. No person9 fi.rm, or corporatian shall make or cause to be made any opening or excavation in the paved or unpaved portion of any vi].lage road or highway9 whether dedicated or undedicated, nor :eross "- any such village road or highway to connect with ar;y sewer, wa'-?er main, or ather public utility' except upon the following terms ard condit3.ons s (a) He shall obtain a permit for such work in such form as shaJ1 be prescribed by the Village Solicitor and signed by the Village Street Cormnissioner. Arayon:e obtaining such permit sha1l agree to repair and sha].l repair promptly all b roken pavement and sidewal.ks' and shall. agree -to and shall baakfill wi.th sand or gravel ariy hole or excavation caused by the work done, to tHe satisfaction of the Village Street Commissioner, and shall f'urther agree to absolve the V'illage of Mayfield ( and also the City of Cleveland in cases of water mains) from a7.l 1a.ability for the work authorized by such permi.t and to indemnity the Village of illayfield ( and the City of C.l.eveland in cases of iaater maim) against arr.y liabi].ity for injury to the street or to person or property by reason of such -v1ork. A fee of 65.00 payab7.e to the Vi].].age of Mayfield, sha]1 b e paid for each permi.t granted hereunder. Such permit ho7.der shall barricade a11 excavations on and off the exi.sting street lire, and sha.11, for the period beginning one hour before sundawh and ending one hour after sunrise during the progress of such work, plainly mark and indicate the presence of a11 barricades, fences, canopies, equipment' piles of material and piles of debris exi.sting on or near the existing street line' using f].ares9 red lanterns or red electric light_bulbs to warn persons and operators of vehicles of the presence of the samem IIpon fai].ure of the permit ho3der to erect the barricades and to set out the means of i7.1.umination herein , required., the vil7 age street cornmissioner or any member of the village police department may do so, and the perm3.t ho7Lder shall in sueh case pay to the Vi17.age the sum of '420900 for each day on which the street . Crnnmissioner or a member-of the police depar-iinen.t has erected sueh barricades or set out such means of illurnination and shall also pay the reasonab].e cost of ariy niateria7Ls used for such pux°pose by the Village af t4ayFieZda (b) tHe sl1al'!. carry liability insurance proluecting the ViLage or Mayfield ( and the Cit,y of Cleveland in cases of wa-ter mains) in the amount of $100,000.00 as to an,y one person and $300*000.00 as to a11 persons by reason of gersonal injury or death and in.the amount of $1$000o00 by reason of damage to property caused by tlle vorlc authorizPd by said perrni.t.
