ORDINANCE No. 734 By Mr. Belzer AN ORDINANCE REQUIRING A CASH BOND, LIABILITY INSURANCE, ' APPROVAL OF ARCHITECTURAL BOARD OF REVIEW, AND NOTICE TO CERTAIN PROPERTY OWNERS., FOR MOVING, REMOVING, OR DEMOLITION OF BUILDINGS, STRUCTURES OR SUBSTANTIAL PARTS THEREOF, AND PROVIDING PENALTIES AND REMEDIES FOR VIOLATION THEREOF. _ BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE- OF HAYFIELD, CUYAHOGA COUNTY OHIO THAT: Sec. 1. No person, firm or corporation shall move, remove or demolish any building or structure or substantial part thereof and no person shall receive a permit for such work, unless he shall comply with all of the following require- ments, unless waived by Council; within the Village of Mayfield, Ohio: (a~ A cash bond in the amount of $1,000.00, or such larger amount as the Building Inspector may in writing require as in his judgment being necessary for the protection of public and private property, shall be deposited with the Village Clerk. Said deposit shall be refunded to the person malting the same upon proof of his compliance with all of the ordinances of the Village of Mayfield and other laws applicable to the performance of such work and further provided that he has compensated the Village of Mayfield and any other person or persons entitled to such payment for all property damage caused by the person making such deposit in the performance of such work, and this applies to any public damage to public roadse otherwise, the ~~~ Village may deduct from the amount of the cash deposit the reasonable cost, as determined by the Building Inspector, of repairing such damage and shall return to the permit holder any unexpended balance. If the cost of repairing such roads or property is in excess of the amount of the cash deposit, the permit holder performing such work shall nevertheless remain liable to the village or the property owner or owners, as the case may be, for any excess damage. (b) The permit holder shall carry liability insurance, protecting the Village of Mayfield against liability in the amount of $100,000.00 as to any one person and $300,000.00 as to all persons by reason of personal injuries and death and in the amount of $25,000.00 by reason of damage to property caused by the work authorized by the permit. The Building Inspector may require the permit holder to deposit said policy. or proof thereof with him.
