Inasmuch as Council has conclusively determined that the portions of <br />-the streets hereinabove named to be improved by water mains and appurtenances <br />are so situated in relation to each other that, in order to complete the improve- <br />ment thereof in the most practical and economical manner, they should be improved <br />at the same time, with the same kind of materials, and in the same manner, it is <br />hereby ordered that said improvement of said streets shall be performed under a <br />single contract, <br />Sec. 2. All claims for damages resulting therefrom shall be judicially <br />enquired into after the completion of the proposed improvements, and the <br />Solicitor is hereby authorized to institute proceedings in a court of competent <br />jurisdiction to enquire into claims. <br />Sec. 3. The entire cost of said improvements shall be assessed in <br />proportion to the benefits which may result from the improvements upon the <br />following described lots and lands, to-wits <br />All lots and lands bounding and <br />abutting upon the proposed improvements; <br />that the cost of said improvements shall include the expense of the preliminary <br />and other surveys, and of printing and publishing the notices, resolutions and <br />ordinances required, and the service of said notices, and the cost of construction, <br />together with interest on notes and bonds issued in anticipation of the collection <br />of deferred assessments, and all other necessary expenditures. <br />Sec, 4. The assessments so to be levied shall be paid in such number <br />of annual installments as may be necessary to service the bonds to be issued in <br />anticipation thereof, with interest on def erred payments at the same rate as <br />shall be borne by the bonds to be issued in anticipation of the collection <br />thereof; provided, that the owner of any property assessed may, at his option, <br />pay such assessment in cash within thirty (30Z days from and after the passage <br />and legal publication of the assessing ordinance. <br />Sec, 5. Bonds of the Village of Nlayfield shall be issued in anticipation <br />of the collection of assessments by installments and in an amount equal thereto, <br />and notes of said Village of Mayfield shall be issued in anticipation of the <br />levy of such assessments and the issuance of bonds, <br />Sec, 6, The Clerk and Mayor of the Village of Piayf field are hereby <br />authorized and directed, as soon as funds therefor are available, to make and <br />execute a contract for said improvement with the lowest and best bidder, after <br />advertisement according to law. <br />Sec. 7. This Ordinance shall take effect as an emergency measure for <br />the reason that the funds are required for the immediate construction o f <br />said improvement for the peace, health and safety of the inhabitants of the <br />Pillage of Mayfield, and shall take effect and be in force from and after the <br />date of its passaged <br />Passed this 17th day of July, 1961. c~~~~~ <br />Attesth ~ ~ <br />Mayor - PresLdent of Council <br />(SEAL C~.~er~c <br />
