in addition, all costs of inspection by the Village Engineer <br />and the Village Inspector during construction of said improvements, <br />and cost of damages to existing facilities, the fees of the <br />Village Engineer and Village Inspector shall be based on the <br />ordinance governing fees and rates of compensation for the Village <br />Engineer. If the sum fixed proves to be inadequate, the Owner, <br />upon notice.to do so, shall deposit such additional amount <br />forthwith. If there is a surplus, such excess shall be returned <br />to the Owner. This deposit shall be in the Village Treasury <br />before any work. is done by the Village Engineer to the approved <br />established grade, plans, and specifications for all underground <br />improvements. If such deficiencies of these funds occur during <br />the construction of the improvements, the Owner shall have a <br />period of seven days to make the necessary deposit; if the Owner <br />fails to comply, the Village Engineer may order the discontinuance <br />of the construction of the improvements until the Owner complies <br />with the regulations. As soon as the established grade is approved <br />by the Village Engineer, the plan therefor shall be submitted by <br />him to Council for its approval. As soon as plans and specifications <br />have been approved by the Village Engineer, Cuyahoga County Sanitary <br />Engineer, Cleveland Water Department, and Council, the Owner may <br />proceed with construction. _. <br />d. The Owner shall enter into contract with a Contractor for the <br />following listed improvements <br />1) Contract for clearing, grubbing and grading the streets. <br />2) Contract for storm and sanitary sewers, water main, all <br />curb connections, and appurtenances. <br />3) Contract for the construction of a temporary pavement. In <br />order to provide for the maintenance of the temporary pavement, <br />the Owner shall deposit in the name of the Village in a bank <br />or savings and loan company an amount to be fixed by the Village <br />Engineer, equal to 5% of the total cost of the temporary pavement. <br />If the Owner ref uses ,to comply with the Village Engineer's order <br />to perform any such maintenance as may be required, the Village <br />Engineer shall proceed to do such worlc using funds previously <br />deposited for the maintenance. of the temporary pavement. <br />The Contractor shall provide evidence that he is carrying <br />public liability insurance covering himself and the Village <br />in the amount of $100,000 - $300,000. <br />e. The owner shall present to the Village Engineer an estimate of <br />cost for subgrading and constructing a permanent pavement in <br />accordance with the specifications attached to this Ordinance. <br />A Surety Bond, or security in such form as may be approved by <br />Council, in the amount of 100% of this estimate or as revised by <br />the Village Engineer, shall be given the Village guaranteeing that <br />all of this work will be completed during the summer or fall following <br />the completion of all underground construction, which date of com- <br />pletion of the permanent pavement shall not be later than December <br />15th of the year the work is started. <br />
