Mason <br />AN ORDINANCE GOVERNING THE EXTERIOR APPEARANCE <br />,AND CONDITION OF PREiylISES, AND, PROVIDING A <br />PENAZTY _FOR VIOLATIONS THEREOF< _ - <br />BE IT ORDAINED BY T"dE COUNCIL, OF THE VIZ,ZAGE OF I~IAYFTEI,D, CUYAHOGA COUNTY <br />.OHIO, THAT: _ ... - - -.-_. <br />Sec. 1. Exterior property areas of all premises shall be kept <br />free of any object, material, or conditions which may create a health, <br />accident or fire hazard, public nuisances, or qualif ied nuisances which <br />adversely affect 'the value of adjacent, surrounding or nearby premises <br />because of unsightly or ugly appearance or because of any of the hazards <br />hereinabove named. Some examples of qualif ied nuisances are outdoor <br />storage of seldom moved or immovable vehicles in conspicuous positions <br />where such storage is not part of a business lawfully conducted and <br />permitted on the premises, collections of rubbish, debris, junlc, scrap <br />metal, papers, rags, glass, stones, motor vehicles without current year <br />license plates which are unhoused, disabled, or disrnantled, and other <br />unsightly and objectionable materials outside of buildings in .residential <br />and commercial districts, and the permitting of buildings to fall into <br />serious disrepair and unsightly appearance, including the laclc of painting <br />so as to reveal uncovered wood areas showing evidence of drying out or <br />similar defects, broken down, sagging or unrepaired fences, and similar <br />nuisances. <br />Sec< 2. Prior to the filing of an Affidavit in -the I~Iayorts Court <br />or in an appropriate I~Sunicipal Court for the violation of the prohibition <br />against any of the nuisances or conditions hereinabove stated, the <br />Building Inspector or other off ieial investigating or seeking compliance <br />with the provisions of this ordinance shall cause a three-day notice in <br />writing to terminate the nuisance to issue to the owner or occupant of <br />the premises0 Notices to the occupant may be served in person, by <br />ordinary mail, or by leaving the notice in a conspicuous place on the <br />premises. Notices to the owner may be personal, by ordinary mail to <br />the tax mailing address, or left at the ownerxs place of residence, <br />Sec. 3. Anyone being the owner or occupant of any premises <br />within the Village of i~Iayf ie1d, who shall violate any of the provisions <br />of this ordinance, shall be guilty of a misdemeanor and upon conviction <br />thereof shall be fined not less than X10,00 and not more than $500.00, <br />and shall stand committed until such fine is paid os is otherwise <br />
