This <br />driveway easement shall be non- ' <br />exclusive and shall be within the 50 <br />westerly-feet of plaintiffs' property <br />as described in Exhibit C attached <br />hereto, and the exact location within <br />the 50 feet shall be~designated by <br />the plaintiffs for that purpose. The <br />easement shall remain in effect only <br />as long as the owner and/or user of` <br />Permanent Parcel No. 831-13-5, has no <br />other access to public highways and ~ <br />shall be.strictly limited to uses for <br />Permanent''~Parcel"No.:831-13-5 only. <br />... :_ s <br />The court has reviewed the::;`agr-Bement between the parties and <br />finds it reasonable and fair under the circumstances herein. <br />IT IS THEREFORE ORDERED,, ADJUDGED AND DECREED that: <br />1. The present zoning categories of the <br />subject property of 14.06 acres are <br />unconstitutional and void as applied <br />to the subject property. <br />2. The Mayfield Village Council shall, <br />adopt an ordinance-or ordinances <br />embodying `the agreement of the <br />parties as set forth. in Items 1, 2, <br />5, 7, 8, 9, 10 and ll, above within <br />sixty days... <br />3. The said. ordinance or ordinances <br />shall take effect immediately upon <br />adoption by',the Mayfield Village <br />Council. ~ ~. <br />4. Since the-ordinance or ordinances <br />adopted pursuant to this order are <br />being adopted under court decree, the <br />' ~ordinance,or•ordinances so adopted <br />shall not be subject to the provi- <br />sions of Article .III, Sections 11, <br />12, 13 and 14, Article VII, Sections <br />1, 2, 3, 4,~5 and 6, or any other <br />• provisions..of the,, Mayfield Village <br />Charter . -. - . <br />5. The `plaintiffs, within sixty days of <br />the effective date of the ordinance <br />as ordinances so adopted under this <br />decree, exe^ute the appr:~priate <br />documents-embodying the agreements of <br />-11- <br />• <br />y <br />
