SB/sam 1/4xc 9/19/85 <br />EASEMENT AGREEMENT <br />THIS AGREEMENT entered into this day of <br />1985, by and among S. W. (hereinafter <br />referred to as "Grantor"),~ and the VILLAGE OF HAYFIELD, an Ohio <br />municipal corporation (hereinafter referred to as "Grantee"). <br />WITNESSETH: <br />WHEREAS, Grantor is the owner in fee simple of a <br />certain parcel of real property (.hereinafter referred to as the <br />"Easement Premises") described in Exhibit "A" attached hereto and <br />made a part hereof;-and <br />WHEREAS, Grantor desires to construct. upon the Easement <br />Premises, in-..accordance with plans approved by Grantee's Engineer, <br />a sanitary sewer. to service. Hanover Woods Subdivision; and <br />WHEREAS, Grantee has agreed that upon construction of <br />said sanitary sewer in accordance with plans. approved by Grantee's <br />Engineer, it will maintain. said sanitary sewer. <br />NOW, THEREFORE, in consideration of Ten Dollars ($10.00) <br />and other good and valuable considerations, the receipt of which <br />is hereby acknowledged by Grantor, and in consideration of the <br />mutual covenants, promises and agreements herein contained, <br />Grantor and Grantee hereby agree as follows: <br />1. Grantor hereby gives, grants, bargains, sells and <br />conveys unto Grantee, its successors and assigns, the non-exclusive <br />right and easement to construct, maintain, operate, inspect, <br />repair, replace, alter and add to sanitary sewer lines, manholes, <br />service pipes, and other fixtures and appurtenances deemed by <br />Grantee to be necessary therefor, through, across, over and under <br />the Easement Premises. <br />2. Grantor agrees that the easement hereby granted <br />shall not be encroached upon by erection of buildings or permanent <br />enclosures which would interfere with access to the facilities <br />located within the easement area,.. or which would otherwise <br />obstruct access thereto. <br />~. <br />x~~a~T {~ <br />
