3. Grantor, for himself and his heirs, executors, <br />administrators, legal representatives and assigns, hereby coven- <br />ants, represents and agrees that he, at his sole cost and expense, <br />will construct within the Easement Premises a sanitary sewer and <br />all appurtenances thereto in accordance with plans. approved by <br />Grantee's Engineer. <br />4. Grantee, for itself and its successors and as- <br />signs, hereby covenants,. represents and agrees that after the <br />date of acceptance by Grantee's Engineer of the sanitary sewer <br />and appurtenances thereto to be constructed by Grantor in the <br />Easement Premises, Grantee, at Grantee's sole cost and expense, <br />shall maintain, repair, restore and replace said sanitary sewer <br />and all appurtenances thereto within the Easement Premises, and <br />that Grantee, its successors and assigns, shall repair and <br />restore any damage done by Grantee, its successors and assigns, <br />to any portion of the Easement Premises which may result from any <br />such maintenance., repair or replacement. <br />5. In the event that the use of the easement herein <br />granted is discontinued for a period of one (1) year, the Grantee <br />shall have-the right, but shall not be required to enter upon the <br />Easement Premises and remove all pipes, mains and other equipment <br />which have been placed on the Easement Premises, and at the <br />expiration of the aforementioned one-year period, the within <br />grant of easement shall terminate. <br />6. Doris Caplan, wife of the said Grantor, does <br />hereby forever remise, release and surrender all of her right of <br />dower in and to the Easement Premises in connection with the <br />easement granted herein. <br />IN WITNESS WHEREOF, the parties have hereunto set their <br />respective signatures on the day and year first above written. <br />In the Presence of: <br />S.
