M.V. RESOLUTION N0. 85-65 <br />Page -2- <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Council finds that the use of the property <br />hereinafter described as an auto body repair shop and towing service <br />for automobiles will substantially serve the public convenience. and <br />welfare and will not substantially or permanently injure the <br />appropriate use of the neighboring property, and further that such use <br />will not be injurious, obnoxious or offensive by reason of emission of <br />refuse water, odor, dust, fumes, vibrations, smoke, gas, noise or <br />otherwise and will not be dangerous or harmful to lif e, health, <br />property or morals and will not cause undue congestion on the public <br />highways. <br />Section 2. Council hereby confirms the permit and <br />approval granted by the Planning and Zoning Commission of Mayfield <br />Village on October 21, 1985 to Jeanne Meyers, personally, to operate <br />an auto body repair shop and towing service for automobiles as a <br />Special U-5 Use Permit upon the following described premises, subject <br />to the conditions hereinafter set forth: <br />Situated in the Village of Mayfield, County of Cuyahoga, <br />and State of Ohio, and known as being a part of Original <br />Mayfield Township Lot No. 45, Tract No. 1, and bounded and <br />described as follows: <br />Beginning in the center line of S.O.M. Center Road at <br />the most Southeasterly corner of a parcel of land conveyed to <br />Paul Leo Schulz, January 13, 1893, and recorded in Volume 4285, <br />Page 27, of Cuyahoga County Deed Records. Thence due North along <br />the center line of S.O.M. Center Road 15 feet to a point. Thence <br />North 890 33' 22.5" West and parallel to Schulz's southerly <br />line a distance of 348 feet to a stone. Thence due North a <br />distance of 243 feet to an iron pipe stake set in a southerly <br />line of land conveyed to the State of Ohio by a deed recorded in <br />Volume 7863, Page 598 of Cuyahoga County Deed Records. Thence <br />North 890 33" 22." West and along a southerly line of land <br />conveyed to the State of-Ohio as aforesaid a distance of 180 feet <br />to an iron pin stake. Thence due South and along an Easterly <br />line of land conveyed to the State of Ohio as aforesaid a <br />distancce of 258 feet to an iron pin stake set in a southeasterly <br />corner of land conveyed to the State of Ohio as aforesaid, said <br />pin being also in the Northerly line of a parcel of land conveyed <br />to the Mayfield Rural School District, October 14, 1924, and <br />recorded in Volume 3317, Page 361, of the Cuyahoga County Deed <br />Records. Thence South 890 33' 22.5" East and along the <br />southerly line of land conveyed to Paul Leo Schulz as aforesaid a <br />distance of 528 feet (passing through an iron pin stake at 498 <br />feet) to the place of beginning and containing 1,185 acres of <br />land according to the survey of S. John Sheahan, Registered <br />Surveyor, in May, 1961. <br />
