M.~l. RESOLUTION N0. 85-65 <br />Page -3- <br />Sectiol} 3. The Special Use Permit granted herein is <br />subject to _the following terms and conditions: <br />A. That the strip of land 15 feet wide and extending <br />West from S.O.M. Center Road between parallel lines a distance <br />of 348 feet to the stone, as set forth in the legal description <br />of the property, shall not be considered or included in said <br />Special Use Permit and said strip of land shall continue to <br />remain as a Class U-1 Use District and no parking of any vehicles <br />shall be permitted thereon; <br />B. The Building existing on the premises as of the date <br />hereof shall not be enlarged, altered or expanded; <br />C. The Permittee shall maintain the wooden split two rail <br />fence along the Southerly property line from the existing eight <br />foot chain link fence to the rear of the garage on the <br />residential property to the South; <br />D. The Permittee shall maintain the four foot chain link <br />fence with metal inserts or "slats" designed so as to create a <br />fence opaque in nature on the East property line from the North <br />end of the existing driveway to the North property line; <br />E. All fences either existing or erected in accordance <br />herewith shall be kept and maintained in good condition by the <br />Permittee; <br />F. The Permittee shall not erect any signs on the subject <br />property except those existing as of the date of the adoption <br />hereof ; <br />G. This permit shall not be assigned or transferred without <br />first obtaining the approval of the Planning and Zoning <br />Commission and Council of Mayfield Village; <br />H. No Nuisance shall be maintained or permitted on the <br />premises; <br />I. There shall be no burning of tars or rubbish on the <br />premises; <br />J. All automobiles. shall be removed from. the premises <br />within ninety (90) days from the date they are first brought on <br />to the premises; <br />K. Except for abandoned automobiles, all automobiles on the <br />premises shall bear a valid State License Plate and have current <br />Ohio License Plate Validation Stickers or their equivalent from <br />another State. <br />L. This Permit may be suspended for any period of time or <br />revoked by the Planning and Zoning Commission upon 10 days <br />written notice and hearing for any one or more of the following <br />reasons: <br />(1) Failure to comply with any laws or ordinances <br />applicable to the. business and operation of the auto <br />body repair shop or towing service for automobiles; <br />(2) Failure to pay any taxes due to Mayfield Village <br />in connection with the business of the Permittee. <br />(3) Operation of the business authorized by this <br />Permit in a manner determined by the Planning and Zoning <br />Commission to be detrimental to the health, safety, morals <br />or welfare of the residents of Mayfield Village or in such <br />
