RESOLUTION N0. 85-65 Page -4- a manner as to constitute a nuisance, or permitting the grounds or buildings to become unsafe or unsightly; (4) Abandonment of the use of the premises as an auto body repair shop or towing service for automobiles for a continuing period of one (1) year or longer. M. The Permit granted herein shall be effective only so long as the Permittee remains an occupant of the subject premises. N. The Permittee must maintain a current log detailing the date on which each automobile is brought on to the premises and the date on which each automobile is removed from the premises, and which log shall be made available to the municipality at reasonable times and locations to a member of the Building Department designated by the Mayor. Section 4. The Permittee shall have no more than ninety (90) days to comply with any violation of the terms and conditions set forth hereinabove, said ninety (90) day period to commence after the Permittee receives written notice from the municipality of such violation. Section 5. The Special Use Permit granted herein shall be in force and effect for a period of six (6) months following the effective date of ~~~this Resolution. Section~6. Any ordinance or resolution in conflict with this resolution in whole or in part is hereby repealed to the extent necessary to avoid conflict with this resolution. Section 7. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. Section 8. This Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the health, safety and welfare of the residents of Mayfield Village in that it will help insure the nuisance free operation of a commercial enterprise in a residential neighborhood thereby protecting the values of the neighboring property. It shall therefore take effect immedi- ately upon passage by the affirmative vote of not less than four (4)
