RESOLUTION N0. 84-29 <br />INTRODUCED BY: Mayor Fred N. Carmen <br />A RESOLUTION AUTHORIZ ING MAYFIELD <br />VILLAGE TO PARTICIPATE IN <br />PURCHAS ING CONTRACTS WITH THE OH IO <br />DEPARTMENT OF TRANSPORTATION AND <br />DECLARING AN ENiERGENCY, <br />WHEREAS, Section 5513.01 of the Ohio Revised Code provides <br />that the Director of the Ohio Department of Transportation may permit <br />any political subdivision to participate in contracts into which the <br />Director of Transportation has enterea for the purchase of machinery, <br />materials, supplies, or other articles; and <br />WHEREAS, purchases made by political subdivisions pursuant <br />to Section 5513.01 are exempt from competitive bidding as required by <br />law for the purchase of such machinery, materials, supplies or other <br />articles; and <br />WHEREAS, the Council of Mayfield Village, Ohio has <br />determined that it is in the best financial interests of the munici- <br />pality to be included as a joint purchaser with the Ohio Department of <br />Transportation; now, theref ore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. The Mayor and Council of Mayfield Village, <br />Ohio, hereby request that the Director of the Ohio Department of <br />Transportation permit Mayfield Village to participate in certain <br />contracts into which the Director has entered for the purchase of <br />machinery, materials, supplies or other articles, all of which is in <br />accordance with Section 5513001 of the Ohio Revised Code. <br />Section 2. Mayfield Village hereby agrees to be bound by <br />such terms and conditions as the Director of Transportation prescribes <br />for the purchases authorized in Section 1 hereinabove. <br />Section 3. The Clerk of Council is hereby authorized and <br />directed to forward two (2) certified copies of this Resolution to <br />Warren J. Smith, Director of the Ohio Department of Transportation, 25 <br />So. Front St., P.O. Box 899, Columbus, Ohio 43216. In forwarding the <br />certified copiesP as aforesaid, the Clerk of Council shall furthermore <br />request that the Director of the Ohio Department of Transportation <br />endorse one of the certified copies on the line provided for his <br />signature and return the same to the Clerk of Council for permanent <br />safekeeping with the Village. The other such certified copy shall <br />remain with the Director of the Ohio Department of Transportation for <br />implementation of the joint purchasing arrangement authorized therein. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this
