RESOLUTION 'N0. 84- 34 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION RATIFYING A FEE AGREENIENT WITH ATTORNEY <br />CHARLES R. MILLER FOR REPRESENTATION ON BEHALF OF THE <br />MUNICIPALITY IN MAYFIELD VILLAGE ve AINTREE NORTH <br />DEVELOPMENT CO.,, ET AL., AUTHORIZ ING PAYMENT TO <br />ATTORNEY CHARLES R. MILLER FOR SERVICES RENDERED <br />THROUGH AUGUST 27, 1984 AND DECLARING AN EMERGENCY. <br />WHEREAS, Mayfield Village v. Aintree North Development <br />Co., et al. is still pending in the Cuyahoga County Court of Common <br />Pleas, the same being Case No. 15297; and <br />WHEREAS, the Mayor and Council have previously determined <br />that a change of Council for the municipality in the aforesaid matter <br />was warranted; and <br />4. <br />WHEREAS, pursuant to that decision the Mayor and Council <br />interviewed attorneys to assume representation on behalf of the <br />Village and in so doing determined that Attorney Charles R. Miller was <br />best qualified for that representation; and <br />WHEREAS, Attorney Charles R. Miller.has assumed the repre- <br />sentation of the Village in the subject litigation and has only <br />recently submitted a bill to the municipality for services rendered <br />from January 17, 1984 through August 27, 1984 in the amount of <br />Fourteen Thousand Eighty Two Dollars ($14,082.00), said fee being in <br />accordance with the original terms and conditions under which Attorney <br />Charles R. Miller was retained; and <br />WHEREAS, the Village has inadvertently failed to enact the <br />appropriate legislation to retain the services of Attorney Charles R. <br />Miller and is desirous of not only paying the invoice due but also <br />setting forth the terms anc3 conditions of that con,tractual relation- <br />ship; now, therefore, , . -, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THATt <br />' N <br />Section 1. The Council of Mayfield 'Village, Ohio, hereby <br />ratifies the retention of Attorney Charles`R. Miller to represent the <br />municipality in Mayfield Village v Aintree North Development Co.o <br />et al., the same being Case No. 15297 in the Cuyahoga County Court <br />of Common P1 eas . <br />Section 2. Attorney Charles R. Miller shall personally <br />conduct or directly supervise all activities pertaining to his repre- <br />sentation of the Village in the subject litigation including, but not <br />limited to, the preparation and filing of all necessary pleadings, <br />motions, and briefs; the participation in all discovery proceedings; <br />and the attendance at all status calls, pretrials, motion hearings and <br />trial. <br />Section 3. The Mayor and Director of Finance are hereby <br />authorized and directed to ratify a fee agreement with Attorney
