Miller, effective January 17, 1984 and retroactive thereto, <br />at the following rates of compensation: <br />(a) For Attorney Charles R. Miller, the sum of Eighty <br />Five Dollars ($85.00) per hour for all out-of-Court services. <br />(b) For Attorney Charles R. Miller the sum of One <br />Hundred Fifty Dollars ($150.00) per hour for all in-Court <br />servicese <br />(c) For any attorneys associated with or employed by <br />Attorney Charles R. Miller a sum not to exceed Forty Dollars <br />($40.00) per hour, whether for in-Court or out-of-Court services. <br />Section 4, The Mayor and Director of Finance are hereby <br />authorized and directed to pay to Attorney Charles R. Miller the sum <br />of Fourteen Thousand Eighty-Two Dollars ($14,082.00) for his services <br />rendered on behalf of the municipality in the subject litigation for <br />the period January 17, 1984 through August 27, 1984. <br />Section 5. It shall be the affirmative duty of Attorney <br />Charles R. Miller to keep the Mayor and Council fully and completely <br />informed of all developments with regard to the subject litigation. <br />No settlement on behalf of Mayfield Village shall be proposed nor <br />consummated without prior consultation with Council and the approval <br />of a majority vote thereof. <br />Section 6_, The contractual arrangement authorized herein <br />shall remain in force and effect until the subject litigation has <br />concluded and, furthermore, shall be cancellable by either party upon <br />providing written notice to the other sixty (60) days prior to such <br />effective date of termination. <br />Section 7. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compli- <br />ance with all statutory requirements including the requirements of <br />Section 121022 of the Ohio Revised Codeo <br />Section 8 This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reasons set forth in the preamble hereto.
