_ Mayor and Council <br />Village of Mayfield <br />May 20, 1988 <br />Page Two <br />C. FEES - HOURLY RATE. <br />As I explained to you, because of the nature of the matter, and <br />because of the possibility of the occurrence of presently <br />unpredictable and unforeseen circumstances, we are not in a <br />position to quote you a specific fee for our professional <br />services. We will, however, represent you on an hourly basis. <br />Although my normal hourly rate for professional services is <br />$150.00 per hour, as a professional courtesy, you will be billed <br />for my services at the rate of $125.00 per hour with fractions of <br />hours computed in periods of not less than one quarter of an <br />hour, and will take into account interruptions of other work. <br />Each such hour is based upon actual work on your particular case. <br />Associate counsel and paralegal personnel from this office who <br />have lower hourly rates may be employed in our discretion, and <br />any such associates so employed may be designated to appear on <br />your behalf or undertake your representation in this matter. We <br />will also attempt to use Village personnel wherever possible to <br />keep your legal expense to a minimum. <br />Absences from the office on your behalf, including travel time, <br />will be charged at the attorney's hourly billing rate, although <br />we shall attempt to minimize travel expenses and travel and <br />courthouse time, if any, whenever possible. <br />D. ADVANCES/EXPENSES. <br />In addition to fees for attorney time, any out-of-pocket expenses <br />incurred in investigating or litigating this claim, ineluding <br />such things as court costs, subpoena costs, photos, depositions, <br />court reporter costs, travel expenses, investigative and expert <br />reports, witness fees, use and appearance of experts, and <br />possible exhibits for use at trial, will be charged to you at <br />cost. <br />E. BILLING PROCEDURES/STATEMENTS. <br />The policy of this firm is to issue statements to clients on a <br />monthly basis. Each monthly statement will include an <br />itemization of attorney hours expended and costs and expenses <br />advanced on your behalf for the period since the prior billing. <br />Payment of our invoices is due upon receipt of the statement.
