AQRFFMFNT <br />THIS AGREEMENT is entered into this 17th day of <br />October , 1988, by and between THE CITY OF HIGHLAND <br />HEIGHTS, OHIO, an Ohio Municipal Corporation, located at 5827 <br />Highland Road, Highland Heights, Ohio, hereinafter referred to as <br />the "City" and MAYFIELD VILLAGE, OHIO, an Ohio Municipal <br />Corporation, located at 6621 Wilson Mills Road, Mayfield Village, <br />Ohio, hereinafter referred to as "Village". <br />WHEREAS, the State and Federal Governments in a <br />cooperative effort will be reconstructing Wilson Mills Road in <br />the City and Village from SOM Center Road to Lander Road; and <br />WHEREAS, the Cuyahoga County Engineer has recommended <br />the installation of a new traffic control system by installing <br />new transyt model 1880E controllers and a transyt model 3800E <br />master controller in the place of rehabilitating and reinstalling <br />the existing TRAC Master and coordinating units, modifying the <br />existing croust-honds model DM and transit model 1880 controllers <br />and installing a new TRAC coordinating units east of Alpha Drive <br />that is designed to improve the flow of Wilson Mills Road <br />traffic; and <br />WHEREAS, the Cuyahoga County Engineer has required that <br />the City and Village enter into an agreement to jointly maintain <br />the transyt system since its design and function is such that it <br />benefits both municipalities on the basis of traffic flow through <br />each and furthermore since several of the intersections included <br />within the transyt system traverse the boundaries of the two (2) <br />municipalities; and <br />WHEREAS, it has previously been determined that fifty <br />four percent (54g) of the transyt system is located in the <br />Village and forty six percent (46g) in the City and that the <br />maintenance cost should be apportioned accordingly; now, <br />therefore, <br />W I T N E S E T H: <br />1. The City and Village do hereby agree to jointly <br />maintain the transyt system to be installed on Wilson Mills Road <br />in conjunction with the Wilson Mills reconstruction project. <br />2. The Village shall select the contractor to maintain <br />the transyt system and in so doing shall require that the <br />contractor meet the standards and requirements of the contractor <br />retained to maintain other traffic signals and devices through <br />the Village.
