RESOLUTION No. 663 <br />` By Mr. Shaw <br />A RESOLUTION GRANTING A SPECIAL PERMIT TO SHELL <br />OIL COMPANY TO USE_CERTAIN PRE~!IISES FORA <br />GASOLINE STATION , _ _ _ , , <br />BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA COUNTY, <br />STATE OF OHIO_ THAT: ... __ <br />Sec. 1. Council finds that the use of the property hereinafter described <br />as a gasoline station will substantially serve the public convenience and <br />welfare and will not substantially or permanently injure the appropriate use <br />of other property, and further that such use will not be injurious, obnoxious <br />or offensive by season of emission of refuse, water, odors, dust, fumes, <br />vibrations, smoke, gas, noise, or otherwise, and will not be dangerous or <br />harmful to lif e, health, property or morals, and will not cause undue congestion <br />on the public highways. <br />Sec, 2. Council hereby confirms the permit and approval granted by the <br />Planning & Zoning Commission of the Village of Mayfield, Ohio, at its regular <br />meeting of December 13, 1965, to Shell Oil Company to construct and operate a <br />gasoline station on certain property at the Southeast corner of Wilson Mi11s <br />Road and SOM Center Road, subject to the conditions hereinafter set forth, and <br />more particularly described, as follows; <br />"Situated in the Village of Mayfield, County of Cuyahoga, and <br />State.of Ohio, and known as being part of Original Mayfield Township <br />Zot No. 13 in Tract No. 2 and bounded and described as follows: <br />Beginning at the intersection of the center line of Wilson Mi11s Road, <br />60 feet wide, with the center line of SoO.M. Center Road, 60 feet wide; <br />thence Easterly along the center line of Wilson Mi11s Road, which is <br />also along the Northerly line of.said Original Lot No. 13, 198 feet to <br />a point; thence Southerly and parallel with the., center line of SOM <br />Center Road, 165 feet to a point; thence Westerly and parallel with the <br />center line of Wilson Mills Road, 198 feet to the center line of ~SOM <br />Center Road; thence Northerly along the center line of SO_M Center Road, <br />165 feet to the place of beginning and containing 0.75 of an acre of <br />land, be the same more or less but subject to all legal highways and to <br />a survey by a registered surveyor, excepting and reserving from the <br />above described premises such portion thereof as shall hereafter be <br />required by the State of~Ohio or Cuyahoga County or both for purposes <br />of widening SOM Center Road ( Ohio State Route 91j., and the intersection <br />of SOM Center Road and Wilson Mills Road, whether-such portion of said <br />premises shall be taken_by appropriation or condemnation proceedings or <br />convey by deed or easement pursuant to an agreement with the State of Ohio <br />or Cuyahoga County or both." <br />
