ORDINANCE NO. 85-4 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />AN ORDINANCE REVISING THE ZONE MAP OF MAYFIELD VILLAGE, <br />OHIO, SO AS TO AMEND THE USE CLASSIFICATION OF 14.06 <br />ACRES OF LAND FRONTING ON S.O.M. CENTER ROAD FROM ITS U-1 <br />DISTRICT (SINGLE-FAMILY RESIDENTIAL) AND OFFICE LABORA- <br />TORY DISCTRICT TO U-1 DISTRICT (SINGLE-FAMILY RESIDEN- <br />TIAL) AND PRODUCTION-DISTRIBUTION DISTRICT AND FURTHER <br />REVISING THE SETBACK LINES AND AREA COVERAGE FOR THE <br />PRODUCTION-DISTRIBUTION DISTRICT. <br />WHEREAS, the property described in Exhibit "A" attached <br />herto is located at the southwest quadrant of the intersection of <br />S.O.M. Center and Beta Roads in Mayfield Village, Ohio, and is <br />divided approximately in the middle by an artificial zoning line <br />running north and south parallel to S.O.M. Center Road, with the <br />western half of the property, or 7.04 acres, zoned Office- <br />Laboratory and the eastern half of the property, or 7.02 acres, <br />zoned U-1 (Single-Family Residential); and <br />WHEREAS, the aforementioned property was the subject <br />matter of an action for declaratory judgment in the Cuyahoga <br />County Court of Common Pleas, the same being Case No. 44310; and <br />WHEREAS, the Mayor and Council of the municipality <br />determined, prior to the trial of the subject action, that in <br />order to preserve the U-1 (Single-Family Residential) characzer <br />of the eastern portion of the subject property fronting S.O.M. <br />Center Road, it was necessary to agree to a Court order rezoning <br />the western portion to Production-Distribution; and <br />WHEREAS, The Cuyahoga County Court of Common Pleas has <br />ordered that the subject property be rezoned, as aforesaid, said <br />decree being incorporated herein in its entirety by reference; <br />now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. The Zone Map of Mayfield Village, Ohio, <br />established in Section 1153.01 of the Codified Ordinances of <br />Mayfield Village, Ohio, as amended from time-to-time, is hereby <br />revised by changing the zoning classification of that property <br />comprising 14.06 acres of land at the southwest quadrant of <br />S.O.M. Center and Beta Roads such that the easterly portion de- <br />scribed in the legal description attached hereto and marked <br />Exhibit "B" shall remain zoned U-1 (Single-Family Residential)
