ORDINANCE NO. 85-4 <br />Page Two <br />and the westerly portion described in the legal description at- <br />tached hereto and marked Exhibit "C" shall be zoned Production- <br />Distribution. <br />Section 2. The Village Engineer is hereby authorized <br />and directed to revise the Zone Map of Mayfield Village, Ohio, in <br />conformance with the revision made herein. <br />Section 3. Irrespective of any provision of the <br />Mayfield Village Planning and Zoning Code, the parking setback <br />line for the Production-Distribution District property zoned <br />herein (Exhibit C) shall be 200 feet from the S.O.M. Center Road <br />centerline. <br />Section 4. Irrespective of any provision of the <br />Mayfield Village Planning and Zoning Code, the building setback <br />line for the Production-Distribution District property zoned <br />herein (Exhibit C) shall be 250 feet from the S.O.M. Center Road <br />centerline. <br />Section 5. Irrespective of any provision of the <br />Mayfield Village Planning and Zoning Code, the parking setback <br />line for the Production-Distribution District property zoned <br />herein, (Exhibit C).shall be 60 feet from the present right-of- <br />way line on Beta Drive. <br />Section 6. Irrespective of any provision of the <br />Mayfield Village Planning and Zoning Code, the building setback <br />line for the Production-Distribution District zoned herein <br />(Exhibit C) shall be 100 feet from the present right-of-way line <br />on Beta Drive. <br />Section 7. Irrespective of any provision of the <br />Mayfield Village Planning and Zoning Code, the area coverage for <br />the Production-Distribution District zoned herein (Exhibit C) <br />shall not exceed 200,00 square feet, with a maximum of 75,000 <br />square feet for warehouse uses and 125,00 square feet for office <br />building uses. <br />Section B. In accordance with the order of the <br />Cuyahoga County Court of Common Pleas in Case No. 44310, said <br />decree being incorporated herein in its entirety by reference, <br />the Council does hereby determine that the provisions of Article <br />III, Sections 11, 12, 13 and 14, Article VII, Sections 1, 2, 3, <br />4, 5 and 6, and all other provisions of the Mayfield Village <br />Charter pertaining to the enactment of ordinances are inappli- <br />cable to the rezoning of the subject property.
