ORDINANCE N0. 85-5 <br />Page -3- <br />passable and reasonable condition and rebuilt as necessary <br />to comply with the standards of the municipality at the <br />completion of the construction of the buildings and <br />without expense to the municipality, until final accept- <br />ance of final pavement for maintenance and use. <br />(2) EXCEPT FOR PAV EMENT CONSTRUCTION REFERRED TO IN <br />SUBSECTION (1) HEREINABOVE, THE DEVELOPER SHALL CONSTRUCT <br />ASPHALT PAVEMENT IN ACCORDANCE WITH THE "DETAILED <br />SPECIFICATIONS FOR ASPHALT PAVING" AS PREPARED BY THE <br />VILLAGE ENGINEER AND ON FILE WITH THE MUNICIPALITY. ALL <br />OTHER PERTINENT PROVISIONS OF SUBSECTION (1) SHALL APPLY <br />TO THE CONSTRUCTION OF THE PAVEMENT AUTHORIZED IN THIS <br />SUBSECTION. <br />(3) IN RESIDENTIAL SUBDIVISIONS WHERE THE SMALLEST LOT <br />IS AT LEAST TWENTY FOUR THOUSAND (24,000) SQUARE FEET AND <br />WHERE, IN THE OPINION OF THE VILLAGE ENGINEER, THE <br />TOPOGRAPHY IS UNDULATING SUCH THAT LOT GRADES WILL CREATE <br />DIFFICULTIES IN CONSTRUCTION, THEN THE DEV ELOPER MAY ELECT <br />TO CONSTRUCT AN ASPHALT PAV EMENT IN ACCORDANCE WITH <br />SUBSECTION (2) HEREIIVABOV E OR, ALTERNATIV ELY, AN ASPHALT <br />PAV EMENT WITH FLUSH CURBS AND NO GUTTERS PROVIDED THAT <br />SUCH CONSTRUCTION IS IN ACCORDANCE WITH THE "DETAILED <br />SPECIFICATIONS FOR RURAL ASPHALT PAVEMENT" AS PREPARED BY <br />THE VILLAGE ENGINEER AND ON FILE WITH THE MUNICIPALITY. <br />ALL OTHER PERTINENT PROVISIONS OF SUBSECTION (1) SHALL <br />APPLY TO THE CONSTRUCTION OF THE PAV EMENT AUTHORIZED IN <br />THIS SUBSECTION. <br />(b) Curbs and Gutters. WHERE REQUIRED IN SUBSECTION (a) <br />(1) HEREINASOVE, concrete roll curbs integral with the <br />pavement shall be constructed as required in the district <br />where the subdivision is located. Concrete roll curbs and <br />gutters shall be in accordance with the "Detailed Specifica- <br />tions for Concrete Paving of the Village Engineer". Straight <br />curbs may be provided at intersections where rolled curbs are <br />used elsewhere. HOWEVER, WHERE PAV EMENT CONSTRUCTION IS IN <br />ACCORDANCE WITH SUBSECTION (a) (2) HEREINABOVE, THE DEVELOPER <br />SHALL CONSTRUCT VERTICAL CONCRETE CURBS INTEGRAL WITH THE <br />PAV EMENT AND IN ACCORDANCE WITH THE "DETAILED SPECIFICATIONS <br />FOR ASPHALT PAVING" AS PREPARED BY THE VILLAGE ENGINEER AND <br />ON FILE WTH THE MUNICIPALITY. <br />(c) Driveways and Curb Cuts. Driveways and curb cuts <br />should be located along the lowest side of the lot, not <br />less than three feet from side lot line or another driveway. <br />Driveway shall be not less than eight feet and not more than <br />sixteen feet wide in one family districts. Curb cuts for <br />straight curbs and the flare for rolled curbs of driveways <br />shall be three to five feet wider than the driveway pavement <br />on each side; the driveway grade of the apron shall not
