M.V. ORDINANCE N0. 85-19 <br />Page -2- <br />Section 2g The Mayor and Director of Finance are hereby <br />authorized and directed to make application to the Division of Water <br />of the City of Cleveland, Ohio for the assignment by the City of <br />Cleveland of funds in the amount of approximately Twenty One Thousand <br />Five Hundred Forty Seven Dollars and Twenty Five Cents ($21o547.25) <br />currently on deposit with the Division of water of the City of <br />Cleveland and held in escrow by said City for sanitary sewer planning <br />and construction in Mayfield Village, Ohio to Mayfield Village, Ohio. <br />Secti.on 3. The Director of Finance is hereby authorized <br />and directed to make application to the Bureau of Inspection of the <br />State of Ohio for approval of the creation of the Sewer Planning and <br />Construction Funcl pursuant to the provisions of Section 5705.12 of the <br />Ohio Revised Code. <br />Secta.on 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council anc3 of its committees, resulting in such <br />f ormal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121,22 of the Ohio Revised Code. <br />Section 5. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the transfer of funds authorized herein and the <br />establishment of a municipal fund f or deposit thereof is in the best <br />interest of those affected residents. It shall therefore take effect <br />immediately upon passage by the affirmative vote of not less than four <br />(4) members elected to Council and appro al by the Mayor or otherwise <br />at the earliest time allowed by law. <br />r <br />10/21/85 Richard C.
