M.V. ORDINANCE N0. 85-22 <br />Page -2- <br />under his control any stun gun with purpose to use it criminally. <br />(b) Each of the following constitutes prima facie evidence <br />of criminal purpose: <br />(1) Possession or coritrol of a stun gun under <br />circumstances indicating such stun gun is intended <br />for criminal use. <br />(2) Possession or control of a stun gun in <br />attempting or commiting any criminal offense, or <br />in fleeing immediately after such attempt or offense. <br />(c) Whoever violates any provision of subsection (a) <br />hereinabove is guilty of a misdemeanor of the first degree. <br />549.14 Criminal Use of Stun Gun Prohibited. <br />(a) No person shall knowinqly use any stun gun in <br />attempting or committing any criminal offense, or in fleeing <br />immediately af ter such attempt or offense. <br />(b) Whoever violates any provision of this Section <br />is guilty of a misdemeanor of the first degree. <br />Sect,ion 2. All prior ordinances inconsistent with this <br />ordinance in whole or in part are repealed to ?the extent necessary to <br />avoid conflict with this ordinance. <br />Sect,ion 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance.with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reasons set f orth in the preamble hereto. It shall theref ore take <br />eff ect immediately upon passage by the affirmative vote of not less <br />than four (4) members elected to Council and approval by the Mayor or
