M.V. ORDINANCE N0. 86- 7 <br />Page -10- <br />(2) It shall be unlawful for any person to smoke in <br />any area restricted by the provisions of this <br />Section. <br />(3) Any person who violates any provision of this <br />Section is guilty of a minor misdemeanor. <br />(4) Each day on which a violation of any provision of <br />this Section occurs is a separate and distinct <br />offense and shall be punishable as such. <br />(i) Enforcement. <br />(1) Enforcement Agencv: Enforcement shall be <br />implemented by the Fire Department which shall: <br />(i) establish a telephone number through which all <br />complaints by citizens relating to violations of <br />this Section may be directed or referred; <br />(ii) require, while an establishment is undergoing <br />otherwise mandated inspections, a "self- <br />certification`° from the owner, manager, operator <br />or other person having control of such <br />establishment that all requirements of this <br />Section have been complied with. <br />(iii> for establishments found out of compliance with <br />this Section or receiving repeated citizen <br />complaints the Fire Department shall: <br />(A) provide to the proprietor or employer a <br />copy of the provisions of this Section and <br />such advisory assistance to rectify future <br />violations as may be necessary to achieve <br />compliance with the provisions of this <br />Section. <br />(B) to follow-up such investigation and advice <br />with a written directive explaining in <br />detail the steps required in order to <br />achieve future compliance with the <br />provisions of this Section; and <br />(C) if the violations do not cease following <br />the expiration of a reasonable period of <br />time, request commencement of a criminal <br />proceeding by the Prosecutor, as may be <br />appropriate pursuant to the provisions of <br />subsection (h) . <br />(j) Education® The Fire Department shall engage in a <br />_ continuing program to inform and clarify the purposes of this <br />Section to citizens affected by it, and to guide proprietors and <br />employers in their compliance. <br />
