M.V. ORDINANCE N0. 86-7 Page -11- (k) Governmental Agency Cooperation. The Mayor shall annually request such governmental and educational agencies having offices within Mayfield Village to establish local operating procedures to cooperate and comply with this Section and shall urge enforcement of their existing smoking restrictions. (1) Relation to Other Law. This Section shall not be interpreted or construed to permit smoking where it is otherwise restricted by law, nor to relieve any proprietor, employer, or other responsible party from any liablity resulting from exposure to tobacco smoke. (m) Severability. If any provision, clause, sentence or paragraph of this Section, or the application thereof to any person or circumstances, shall be held invalid, such invalidity shall not affect the other provisions, or application of the provisions, of this Section which can be given effect without the invalid provision, or application, and to this end the provisions of this Section are hereby declared to be severable. Section 2(A). New Sections 521.10(a) through 521.10(d) and 521.10 (f) through ,521.10 (m) shall take effect ninety (90) days after the effective date of this Ordinance. (B) New Section 521.10(e) shall take effect ninety (90) days after the certification dates defined in Section 2(C) hereinbelow unless the Mayor certifies to the Council prior to each of such dates that: (1) Each employer that would be regulated by Section 521.10(e) has provided to the Mayor written certification prior to each certification date that he or she has established, implemented and maintained a smoking policy that, at a minimum, complies with the requirements of Section 521.10(e); and (2) Each employer of ten (10) or more employees has provided to the Mayor a copy of his or her written smoking policy including any amendments made since the last certification, if appliable. (C) The certification dates applicable to paragraph (B) hereinabove shall be one hundred eighty (180) days after the effective date of this Ordinance and every ane hundred eighty (180) days _ thereafter.
