See amended copy <br />N0. 89-85 <br />BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />GRANTING A SPECIAL U-6 USE PERMIT TO <br />MAYFIELD UNITED METHODIST CHURCH TO USE CERTAIN <br />\ PREMISES FOR A DAY CARE CENTER <br />FOR A PERIOD OF THREE (3) YEARS <br />AND DECLARING AN EMERGENCY <br />WHEREAS, Mayfield Un'ted Methodist Church, has requested that certain <br />Road be used for a day care center; and <br />premises located at 810 SO \anr <br />use district zoned for <br />WfEREAS, the said preme located within a <br />single-family residential uWHEREAS, the Mayor and Council a nowledge that, pursuant to the provi- <br />sions of Section 1149.02 of the Codifie Ordinances of Mayfield Village, <br />entitled "Use District Exemptions," the lass U-6 use may be permitted in any <br />use district; and <br />WHERL+AS, on November 16, 1989, the Planni g and Zoning Commission recom- <br />mended to Council that a special permit be gran d to Mayfield United Method- <br />ist Church to operate a day care center in compli nce with certain conditions; <br />and <br />WHEREAS, it has been determined by Council that s h use would substan- <br />tially serve the public convenience and welfare and will not substantially or <br />permanently injure the appropriate use of the neighboring roperty; and <br />WHEREAS, the Mayor and Council is desirous of granting a ecial use <br />permit to Mayfield United Methodist Church to operate a day car center in <br />compliance with certain conditions; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Commcil finds that the use of the property located at 81-SOM <br />Center Road as a day care center will substantially serve the public conve <br />nience and welfare and will not substantially or permanently injure the <br />appropriate use of the neighboring property, and further that such use will <br />not be injurious, obnoxious or offensive by reason of omission o£ refuse <br />water, odor, dust, fumes, vibrations, smoke, gas, noise, or otherwise and will <br />not be dangerous or harmful to li£e, health, property or morals and will not <br />cause undue congestion on the public highways. <br />?
