Council hereby confirms the permit and approval recommended <br />by the Planning and Zoning Commission of Mayfield Village on November 16, 1989 <br />to Mayfield United Methodist Church, to operate a day care center as a Special <br />U-6 Use Permit upon the premises, subject to the conditions hereina£ter set <br />forth. <br />SECTION 3. The Special Use Permit granted herein is subject to the <br />following terms and conditions: <br />A. Such premises shall be inspected on an annual basis by the Building <br />and Fire Inspectors. <br />B. The Permit granted herein shall be effective only as long as Toni <br />Novak remains as the director of such operation. <br />C. An appropriate barrier, i.e. fence shall be constructed around the <br />outdoor play area subject to the approval of the Architectural Review Board. <br />D. The Permittee shall erect signs on the property subject to the <br />approval of the Building Inspector. <br />E. This Permit may be revoked for any period of time or revoked by the <br />Planning and Zoning Commission upon ten (10) days written notice and hearing <br />for any one or more of the following reasons: <br />(1) Failure to comply with any laws or ordinances <br />applicable to the business and operation o£ a day care <br />center; <br />(2) Failure to pay any taxes due to Mayfield <br />Village in connection with the business of the <br />Permittee. <br />(3) Operation o£ the business authorized by this <br />Permit in a manner determined by the Planning and <br />Zoning Commission to be detrimental to the health, <br />safety, morals or welfare of the residents of Mayfield <br />Village or in such a manner as to constitute a nui- <br />sance, or permitting the grounds or buildings to become <br />unsafe or unsightly; <br />SECTION 4. The Permittee shall have no more than ninety (90) days to <br />comply with any violation o£ the terms and conditions set forth hereinabove, <br />said ninety (90) day period to commence after the Permittee receives written <br />notice from the municipality of such violation. <br />SECTION 5. The Special Use Permit granted herein shall be in force and <br />effect for a period of three (3) years beginning January 1, 1990.
